RESOLUTION NO. 2365 <br />CITY OF MOUNDS VIEW r <br />COUNTY OF RA.MSEY <br />STATE OF MINNESOTA <br />RESOLUTION ADOPTING A MEDICAL AND DAY CARE EXPENSE <br />REIMBURSEiiENT PLAN AND ADMINISTRATIVE SERVICES AGREEMENT WITH <br />DCA, INC. <br />WHEREAS, the Mounds View Employees Relations Committee has <br />proposed to the Mounds View City Council that the City pro7ide a <br />Flexible Benefits Program to the City's employees thus providing <br />the City and employees with certain tax advantages; and <br />WHEREAS, the Employees Group has further recommended that the <br />Flexible Benefits Program be administered through DCA, I.nc.; and <br />WHEREAS, DCA, Inc. has provided the City with an estimate of <br />expenses and payroll tax savings indicating that the City will <br />experience minimal costs for est.olishment of the program and no <br />costs for annual administration; and <br />WHEREAS, the City Council has determined that it is their <br />desire to approve the recommendations of the Employee Relations <br />Committee establishing a Flexible Benefits Program and entering <br />into an Administrative Agreement with DCA, Inc. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the <br />City of Mounds View that the City of Mcunds View Medical and Day <br />Care Expense Reimbursement Plan be and the same is adopted <br />effective September 1, 1988; , <br />BE IT FURTHER RESOLVED that the City Treasurer of the City <br />of Mounds View is hereby authorized to make such contributions <br />from the funds of the City as are necessary to carry out the <br />provisions of said plan at any time; and <br />BE IT FURTHER RESOLVED in tha event any conflict arisen, <br />between the provisions of said plan and the Employee Retire- <br />ment Income Security Act oZ 1974 (ERISA) or any other applicable <br />law or regulation (as such law or regulation may be interpreted <br />or amended) the employer shall resolve such conflict in a manner <br />which complies with F.RISA or such law cr regulation; and <br />BE IT FINALLY RESOLVED that the Clerk -Admini atrator is <br />authorized to enter into a Flexible Spending Account <br />Administrar.ive Services Agreement between the City of Mounds '.iew <br />and DCA, Inc. for the administration of the aforementioned <br />medical and day care expense reimbursement plan.
