,9tl-ll 3 <br />C <br />MEMO TO: Mayor and City Council <br />FROM: City Planner Herman <br />DATE: December 29, 1988 <br />SUBJECT: ORDINANCE NO. 453 <br />Ac\er&L 5e55'on <br />The attached ordinance is to revise the accessory use or <br />equipment section of the Zoning Code. Currently, air <br />conditioners have only been allowed in the back yard of a <br />residence. This ordinance would allow for air conditioners <br />in the back and side vards along with recreational vehicles <br />and equipment, laundry drying equipment, arbors and <br />trellises, and breezeways. The accessory uses cannot be <br />placed in a side yard when it abutts e. public street. <br />The ordinance aluo requires that all recreational vehicles <br />and equipment be parked five feet from the side lot line. <br />This requirement was added because of a citizen's complaint <br />received this summer. Apparently, the resident's neighbor <br />had bten parking his RV on his lot line and exhaust fumes <br />were going into the resident's home. During investigation <br />of this issue, I had found that the Police Department is not <br />in favor of this change. Concern was expressed over the <br />enforcement of this ordinance and also the concern over <br />selected enforcement. <br />I would like to discuss this issue with the Council at the <br />meeting. <br />KJH/BAC <br />Attachment <br />
