Call to <br />Mayor Hankner at 7 nn PM on Monday, January 91 1989. Order <br />The Pledge of Allegiance was said. <br />MEMBERS PRESENT: Councilmembers Quick, Blanchard, <br />Wuori and Mayor Hankner. <br />ALSO PRESENT: City Attorney Meyers, City Attorney <br />Kerney, Clerk/Administrator Pauley and Public Works <br />Director Minetor. <br />Mayor Hankner noted the Council would be operating with <br />four members until a special election is held in April. <br />f Attorney Meyers updated the Council on recent rulings <br />in the Williams Pipeline case. In her order of January <br />6, Judge Murphy did dismiss certain aspects of both <br />the City and County claims, based on a motion made by <br />Williams. The City will now proceed in court on two <br />issues before the same judge, one being the legal <br />expenses related to the lawsuit, which shruld be heard <br />within 60 days. The balance of the case will be the <br />issue of negligence, with the City alleging Williams <br />was negligent before and on July 8, 1986. As a re- <br />sult, the City is pleading it has been damaged to the <br />extent of property damage sustained, and punitive <br />damages. Judge Murphy has determined the City is <br />authorized to proceed, and the case the City will be <br />presenting will be proving negligence and specifically <br />willful negligence. <br />2.
