ro <br />60 <br />ORDINANCE NO. 466 <br />PAGE THREE <br />(b) To perform work necessary to preserve health, <br />safety, life or property in the case of an <br />emergency. <br />(c) Work performed by any public agency or its <br />contractor. <br />SECTION VI. AMeal Provisions. The City Council <br />shall have the power to vary or modify the application of <br />any provisions of this ordinance u Pon its determination in <br />its absolute legislative discretion that such variance or <br />modification is necessary to alleviate an undue hardwhip, <br />and will not effect the integrity of the comprehensive plan, <br />the City's planning or zoning ordinance, or the Interim <br />Ordinance District, and is consistent with the letter and <br />intent of this ordinance and not the health, safety and <br />general welfare of the City. Upon receiving any application <br />for such variance or modification of this ordinance, the <br />City Council shall refer such application to the Planning <br />Commission with respect to the effect of the prospective <br />variance of modification of the planning process and <br />comprehensive plan. Such report shall be returned by the <br />Planning Commission to the City Council within sixty (60) <br />days following such reference and shall be placed upon the <br />next agenda of the City Council. <br />SECTION VII. Length of Time. This ordinance shall <br />remain effective for one year from the date of its enactment <br />or until such time as said ordinance shall be revoked or <br />otherwise amended. <br />SECTION VIT.I. Penalties. Any person, firm, entity <br />or corporation who violates any provisions of this ordinance <br />shall be guilty of a misdemeanor as defined by state law. <br />SECTION IX. Validity. The validity of any word, <br />sentence, section, clause, paragraph, part or provision of <br />this ordinance shall not affect the validity of any other <br />part of this ordinance which can be given effect without <br />such invalid part or parts. <br />SECTION X. This ordinance shall take effect thirty <br />days after the date of its publication. <br />Read by the Council of the City of Mounds View on <br />this of , 1989. <br />
