0 RESOLUTION NO. 2471 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION AUTHORIZING THE REPAYMENT OF FUNDS USED TO <br />FINANCE THE WILLIAMS PIPE LINE LITIGATION <br />WHEREAS, on the morning of July 8, 1989 the City of <br />:•founds Vice; experienced a catastrophe caused by the rupture <br />+� owned by - <br />of an eight inch hazdYsudb iiluau p:Pe--••lino -• <br />Williams Pipe Line Company, running through the City and <br />subsequent explosion and fires which resulted in the deaths <br />of two Mounds View residents and severe injuries to a third; <br />and <br />WHEREAS. the City of Mounds View, in order to protect <br />the health, safety and welfare of it's residents, initiated <br />litigation which sought removal or replacement of that <br />portion of the pipeline located within the City plus damages <br />and expenses sustained by the City; and <br />WHEREAS, by Resolutions 2116 and 2165 the Council <br />authorized $171,837 of the Fund Balance of the General Fund <br />- that had been designated for Contingencies to be used for <br />pipeline litigation expenses; and <br />WHEREAS, $18,814 of the annual General Fund budgets <br />for 1986 and 1987 have been used for pipeline litigation <br />expenses; and <br />WHEREAS, on April 10, 1989 the Council agreed to a <br />settlement of the pipeline litigation whereby Williams <br />Pipeline Company will undertake a program for the <br />replacement of that portion of the pipeline that runs <br />through the City of Mounds View in conjunction with the <br />County's planned reconstruction of Long Lake Road and in <br />addie Company <br />cityt$250,OOOlams Pipe for damagesnand expensessagreed to pay ustained; <br />the <br />sustained; and <br />WHEREAS, the Council restates it's belief that it is <br />prudent and sound financial management to set aside funds to <br />be used in the event of emergencies. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council <br />of the City of Mounds View hereby states that $171,237 of <br />the settlement received from Williams Pipe Line Company be <br />
