PAULEY, CLERK-ADMINISTRAT / v�7 ` �a <br />DATE: JULY 5, 1989 <br />SUBJECT: 1989 LEGISLATIVE SUMMARY <br />As has been my practice in the past, the following is a <br />summary of all legislation adopted by the most recent <br />session of the Minnesota Legislature pertinent to the City <br />Of Mounds View. I will be listing each item by means of a <br />short title, will reference to the specific chapter of <br />Minnesota laws and then provide a brief summary of the <br />legislation. Should I envision that action be required by <br />the City to address this legislation, I will be including a <br />note under that item indicating what action I feel might be <br />appropriate. <br />1. Dance Hall Regulation - Chapter 10 (FS300) <br />Repealed the Dance Hall Statutes that had required <br />permits and police attendance, prohibited immodest <br />dances or dancing in the dark, and limited hours. The <br />law does not repeal the authority in MS412 for cities to <br />regulate dances. Effective August 1, 1989. <br />NOTE: The City regulates public dances in dance halls <br />with Chapter 108 of the Code. Staff will be presenting <br />O the question to the Council about retaining this in <br />light of State action in the future. <br />2. Vacation of Roads - Chapter 183 (HF400) <br />Requires written notice by certified mail to the <br />Commissioner of Natural Resources of the vacation of <br />roads, streets, alleys and similar public grounds that <br />terminate or abutt upon any public water at least 30 <br />days before the public hearing on the proposed <br />vacation. Public water for purposes of the City of <br />Mounds View would be defined as any wetland of a type 3, <br />4 or 5 nature, Judicial Ditch number 1, Silver Lake ; <br />Woods pond, and Spring lake. Effective August 1, 1989. <br />3. Subdivision Dedications - Chapter 196 (FS811) <br />Expands the provisions of MS462.358, subdivision 2,6 to <br />include that dedication of land or payment of dedication 4 <br />fees resulting from a subdivision may also be used for <br />the preservation and maintenance of wetlands, as well as <br />the previously allowed parks and recreation <br />Effective August 1, 1989. activities. <br />NOTE: Staff will be recommending modification to <br />Chapter 42.13 of the Municipal Code to reflect this <br />statutory change. <br />4. Among the many change made to the State'. solid waste <br />laws, two are of significance to Mounds View. They are: <br />
