MEMO TO: MAYOR AND CITY COUNCIL <br />FROM: CLERK-ADMINISTRATO �J <br />DATE: MAY 22, 1989 <br />SUBJECT: KNOLLWOOD DRIVE EXTENDED RIGHT-OF-WAY <br />The City of Mounds View currently owns a small parcel of <br />land directly south of Knollwood Drive at Ardan Avenue which <br />is dedicated right-of-way for the extension of Knollwood <br />Drive south towards Highway 10. In the past, the City has <br />cooperated with property owners abutting both sides of this <br />right-of-way in cleaning up the right-of-way and attempting <br />to maintain it in an acceptable manner. <br />In mid -April I received a telephone call from Mr. Tim Urman <br />of 2856 Ardan Avenue, the property owner directly east of <br />this right-of-way, requesting that the City allow him to <br />clear the right-of-way which is overgrown with scrub brush <br />and maintain it as a grass surface. I advised Mr. Urman, <br />that his request would need to be made in writing and <br />approved by the City Council and that the City Attorney <br />would need to be consulted regarding any potential liability <br />the City might assume by allowing this property to be used <br />as an extension to his own property. I contacted City <br />Attorney Karney who recommended that a written agreement <br />®, between the City and Mr. Urman be entered into which allows <br />him to clear, seed or sod and mow the property with an <br />understanding that he will not assume any control of the <br />property, nor is it a license to use the property in any <br />other manner. <br />After advising Mr. Urman of the City Attorney's opinion, we <br />received a letter dated May 16, 1989, copy attached, from <br />Mr. Urman requesting that the City level, remove tree <br />stuiaps, and haul black dirt onto the property at which time <br />he would agree to seed and maintain the property with no <br />intentions of attempting to assume ownership. <br />Rather than proceed any further with this request by asking <br />the Public Works Director to make an assessment regarding <br />the cost for clearing the property and hauling in black <br />dirt, I felt it would be appropriate to discuss the matter <br />with you at an agenda session and determine whether or not <br />you were willing to proceed with this matter any further. <br />I am placirg the request on your •June 5th Agende. Session. <br />Should you agree to give further consideration to <br />Mr. Urman's request, I would suggest that staff be directed <br />to determine the cost for clearing the property and hauling <br />in black dirt as well as determining when such work could be <br />completed based upon current workloads. Your direction in <br />this matter would be appreciated. <br />DFP/MJS <br />
