MINNESOTA 55113 <br />TELEPHONE 16120 636."SA <br />' <br />RICHARD METERS <br />December 20, 1908 OF COUNIEL <br />Mr. Don Pauley <br />City of Mounds View <br />2401 Highway lu <br />Mounds View, MN 55112 <br />Dear Don: <br />I. have reviewed the ordinance entitled "Animals" for the <br />City of Mounds View and I just have a few short comments. <br />I have not reviowed the statute with the intent of <br />correcting grammar or misspellings. <br />Under Subdivision 10, number 2, a Municipal pound may be <br />established with a poundmaster appointed by the Council. <br />This is an excellent idea provided the pound is actually <br />established by the City. However, if the City does not want <br />to establish its own pound but wishes to use private <br />facilities that subdivision may run contrary to that. Is it <br />the intent of the City to have its own pound or are you <br />going to us a prior facility? If you are going to use a <br />private facility or think that you may in the future because <br />of the eypense of having a Municipal pound subdivision 10, <br />number 2 should be changed. <br />Under Subdivision 14, it says that an animal will be <br />released upon payment of fees and to the owner. I think <br />something should be put; in there that the animal will only <br />be released to any owner upon adequate proof of. ownership. <br />I do not suspect this will normally be a problem but it is <br />possible that someone nay see a dog in the pound and may <br />come to the pound looking for a dog, find one that they <br />really like and claim ownership to it contrary to the actual <br />owner of the animal. The City could have setae liability <br />then to the owner for release of their dog to someone else. <br />1 would simply suggest that the last sentence read "the <br />poundmaster shall release the dog to any owner upon adequate <br />proof of ownership." Adequate proof could be sworn <br />Affidavit which I would be happy to draw up for the City. <br />The poundmaster would have them sign the Affidavit so we <br />would be removed from any liability for the release of any <br />dogs or animals. <br />
