J /� <br />MEMO TO: MAYOR AND CITY COUNCIL <br />FROH: CLERK-ADMINISTRAT tv <br />DATE: FEBRUARY 28, 1990 <br />SUBJECT: ILLEGAL YARD WASTE DUMPING <br />Staff has undertaken recent discussions at the Department Head <br />level regarding methods of preventing it -legal yard waste <br />dumping and enforcing violations of City Code. After <br />researching City Codes thoroughly we were surprised to learn <br />that it is currently not a violation of any City Code to <br />dispose of yard waste on public lands or private property not <br />owned by the individual. It is a violation. of State Law, <br />however, the State Law is very nebulous in nature and <br />according to Attorney Karney would be difficult to prosecute. <br />Attached for your consideration is Ordinance No. 485 Amending <br />Chapter 104 of the Municipal Code by adding a new Section <br />104.10 Entitled, "Yard Waste" which makes it unlawful for a <br />person, firm or corporation to dispose of yard waste on <br />private or public lands located in the City of Mounds View. <br />The ordinance further renumbers the old Section 104.10 <br />entitled, "Penalty" to 104.11. If Council agrees with this <br />proposed ordinance, staff will further recommend that the <br />illegal disposal of yard waste be made an Administrative <br />Offense with a significantly large penalty to be used as a way <br />to discourage illegal dumping in the City. <br />Your consideration would be greatly appreciated. <br />DFP\MJS <br />
