The <br />property is zoned R-1. • <br />Section 40.10, Subd. D(6) allows accessory buildings exceeding <br />216 square feet by conditional use permit contingent upon the <br />following: <br />1. The accessory building must conform with Sections 40.04, <br />Subd. F and 40.10, Subd: C(2) of the Zoning Code. <br />2. The accessory building shall not exceed four hundred <br />(400) square feet. <br />3. The building must be a permanent structure. <br />4. The building shall be designed and maintained to provide <br />a uniform appearance with the dwelling unit. <br />5. Should the use for which the permit was granted be <br />changed, the permit shall be subject to reconsideration, <br />revocation or other action regulated by Chapter 40.25 of <br />this Code. <br />The applicant has requested a 352 square foot shed on an existing <br />slab and the building would meet all setback requirements. His <br />attached garage has 864 square feet. <br />The proposed location of the shed is not within the buffer zone <br />and does not require a wetland alteration permit even though a <br />portion of the Lot is within the buffer zone. <br />
