^ Home Rule Charter, and the Municipal Code. In the event of <br />nonconformance by the developer, the City shall seek mandatory <br />relief, after written notice of the alleged violations, pursuant <br />to the terms of this contract to enforce this provision and may <br />proceed to abate public nuisances and to assess the cost of said <br />abatement, including all costs, disbursements, legal fees against <br />the development site, as provided for in the Home Rule Charter, <br />Chapter 26 of the Municipal Code, and such other applicable <br />ordinances and Minnesota Statutes. <br />19. The development site shall be developed as :nricated <br />on the attached site plan, referred to as Exhibit 3. The site <br />plan and the development to be constructed thereon may be amended <br />from time to time by the mutual written consent of the parties <br />hereto, in conformance with the Municipal Code of the City. <br />i <br />20. In addition to all of the provisions recited <br />hereinbefore, the Developer agrees to the following additional <br />conditions as more fully set out in Attachment A attached hereto <br />and made a part hereof. <br />21. The provisions of this contract are severable, and in <br />the event that any provision of this agreement is found invalid, <br />the remaining provisions shall remain in full force and effect. <br />
