t RESOLUTION N0. 2546 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION APPROVING A MODIFICATION TO THE MORITORIUM <br />DISTRICT AND WETLAND ALTERATION PERMIT REQUEST BY PIONEER <br />SCHWINN, 2261 COUNTY ROAD I, PLANNING CASE NO. 278-89 <br />WHEREAS, the Planning Commission and City Council have <br />reviewed the requested modification to the moritorium district <br />and the wetland alteration permit to allow the construction of a <br />Pioneer Schwinn dealership at 2661 County Road I (PIN <br />#07-30-23-12-10), and <br />WHEREAS, the City Council has reviewed the proposed <br />development site plans including the building elevations and <br />determined that the proposal is in conformance with the Zoning <br />Ordinance; and <br />WHEREAS, the City Council has reviewed the requested <br />modification to the moritorium district and has determined that <br />it does not meet the intent of the moritorium district; and <br />WHEREAS, the City Council has determined that the <br />applicant has demonstrated a hardship on his property based on <br />the uniqueness of his property and unique character, that is, the <br />minimal 15 foot Highway 10 frontage; and <br />WHEREAS, the City Council has reviewed the requested <br />wetland alteration permit to allow for development in a wetland <br />buffer zone; and <br />WHEREAS, the City Council has determined that the proposal <br />will not affect the integrity of the Comprehensive Plan or the <br />City's Zoning Ordinance or this Interim District; and <br />WHEREAS, the City Council has determined that the proposal <br />is not consistent with the letter and intent of the Moritorium <br />Ordinance; and <br />WHEREAS, the City Council has determined that the proposal <br />does not affect the health, safety and general welfare of the <br />City. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of <br />the City of Mounds View approves the requested modification to <br />the moritorium district and a wetland alteration permit and <br />development site plan for the proposed Pioneer Schwinn Dealership <br />at 2261 County Road I, contingent upon the following: <br />1. All requirements of the City Engineer as outlined in <br />two memos, both dated September 13, 1989, are complied <br />with. <br />
