successors or assigns to permanently maintain the site described <br />herein pursuant to the terms of th;e <br />agreements subsequently entered into, and said Developer shall <br />not permit the premises to deteriorate or become blighted or to <br />constitute a public nuisance, and shall not permit its users or <br />occupants to create a public nuisance. Enforcement of this <br />provision shall be pursuant to the terms of this contract or the <br />provisions of the applicable Minnesota Statutes, the Mounds View <br />Home Rule Charter, and the Municipal Code. In the event of <br />nonconformance by the Developer, the City shall seek mandatory <br />relief, after written notice of the alleged violations, pursuant <br />F`5 <br />to the terms of this Contract to enforce this provision and may <br />proceed to abate public nuisances and to assess the cost of said <br />r <br />a- <br />abatement, including all costs, disbursements, legal fees against <br />the development site, as provided for in the Home Rule Charter, <br />Chapter 26 of the Municipal Code, and such other applicable <br />ordinances and Minnesota Statutes. <br />19. The development site shall be developed as indicated on <br />the attached site plan, referred to as Exhibit 2. The site plan <br />and the development to be constructed thereon may be amended from <br />time to time by the mutual written consent of the parties hereto, <br />in conformance with the Municipal Code of the City. <br />20. In addition to all of the provisions recited herein - <br />before, the Developer agrees to the following conditions as more <br />fu11y set out in Attachment A attached hereto and made a part <br />hereof. <br />21. The provisions of this contract are severable, and in <br />the event that any provision of this agreement if found invalid, <br />the remaining provisions shall remain in full force and effect. <br />- 7 - <br />
