STAFF <br />REPORT <br />'=�-vim zti <br />PLANNING COMMISSION REVIEW DATE; November 1, 1989 <br />AGENDA ITEM NUMBER: <br />CASE NUMBER: 283-89 <br />(Regular Meeting) <br />APPLICANT: Khosrow Daivari <br />REPORT PREPARED BY: Troy Gamble/Michelle Hren <br />APPLICANTS REQUEST: Applicant Requests a Wetland Alteration <br />Permit <br />LOCATION OF REQUEST: 7028 Knollwood Drive <br />The applicant has requested a wetland alteration permit to <br />house at construct an attached garage and kitchen addition to his 028 existing <br />_ completely in thllwOOd Drive <br />The atltlition site lies <br />In 1984 the applicant was issued a building permit for <br />construction of an addition to his existing house. The permit <br />was issued without a wetland alteration permit despite the fact <br />that the addition would partially lie within the 100 foot wetland <br />buffer zone. <br />Section 48.05, Subd. 5(c), of the Wetland Zoning Ordinance <br />from indicates that all structures shall be set back at least 100 feet <br />the wetland. <br />However, <br />minordevelopment inabuffer ezone nw4 h0a wetland4alterations for <br />permit. <br />The proposed development is in compliance with Section 40.10, <br />Subd. C M , of the Zoning Code and meets the required setbacks, <br />height limitations, and area restrictions as outlined in the <br />Code. However, the unimproved driveway that the applicant <br />currently uses (and would like to continue to use as access to <br />the proposed garage) serves both 7028 and 7044 Knollwood Drive. <br />This unimproved driveway Lies on both of the aforementioned <br />properties and apparently has served both properties for many <br />years. <br />According joint driveways cserving- <br />and beibng locatedfonhmorenthan0ordi <br />nenance, <br />property are allowed provided that certain conditions are met. <br />These conditions are as follows: <br />
