r RESOLUTION NO. 271-89 �j1�Yvt� s <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION RECOMMENDING APPROVAL OF THE MINOR SUBDIVISION <br />REQUEST BY VERNON HALL, 2186 BRONSON DRIVE, <br />PLANNING CASE NO. 281-89 <br />WHEREAS, the Planning Commission reviewed the proposed <br />minor subdivision request by Vernon Hall for the property located <br />at 2186 Bronson Drive, legally known as Lambert's Addition, east <br />84 feet of Lot 1, Block 1, as shown on the proposed Certificate <br />of Survey dated September 28, 1989, with revisions dated October <br />25, 1989; and <br />WHEREAS, each of the proposed Lots meet the minimum lot <br />area and width requirements as outlined in the zoning and <br />subdivision ordinances. <br />Section 40.04, Subd. C(3), indicates that a platted lot or <br />parcel of land of record on or prior to May 9, 1960, which <br />does not meet the requirements of this Code as to area, <br />width, or other open space may, if it is properly zoned, <br />be utilized for single family detached dwelling purposes <br />provided the measurements of such area with their open <br />space are within 70 percent of the requirement under the <br />terms of this Code, but said lot or parcel shall not be <br />more intensively developed. Such existing lots that fall <br />within 70 percent of the requirements and have Lot widths <br />less than required by this Code shall be permitted to have <br />side yard setbacks in the same percentage proportion as <br />the Lot width reaches the requirements of this Code. In <br />no case shall the side yard setback be less than five <br />feet. <br />NOW, THEREFORE, BE IT RESOLVED that the Planning <br />Commission of the City of Mounds View recommends to the City <br />Council approval of the requested minor subdivision contingent <br />upon: <br />1. This resolution and Certificate of Survey dated <br />September 28, 1989, be recorded with Ramsey County <br />within sixty (60) days of final adoption. <br />The applicant pay the park dedication fee of $100.00. <br />
