4&4-ev �/ <br />MEMO TO: Mayor and City Council <br />Planning Commission <br />FROM: City Planner Hren <br />DATE: November 28, 1989 <br />SUBJECT: FIRSTAR BANK SIGN REQUEST, 2711 HIGHWAY 10, <br />PLANNING CASE NO. 285-89 <br />Firstar Bank located at 2711 Highway 10 has applied for a waiver <br />of the Highway 10 moritorium district requirements to allow for <br />the construction of a new sign on their property. The property <br />is located within the Highway 10 moritorium district and, as <br />such, is subject to the restrictions outlined in Ordinance No. <br />466. A copy of the Highway 10 moritorium district ordinance is <br />attached for your review. <br />Assuming that the moritorium district was not in place, the <br />proposed sign would meet all requirements as outlined in Chapter <br />39, the Sign Code. The moritorium ordinance allows for an appeal <br />process by which the applicant can request a waiver of the <br />requirements if they meet the conditions outlined in Section 6 <br />entitled, "Appeal Provisions". The conditions are as follows: <br />1. That the modification is necessary to alleviate any undue <br />hardship. <br />2. That the proposed use will not affect the integrity of the <br />Comprehensive Plan. <br />3. That the use will not affect the City's planning or zoning <br />ordinance or the interim ordinance district. <br />4. That the proposed use is consistent with the letter and <br />intent of this ordinance. <br />5. That the proposed use will not affect the health, safety <br />and general welfare of the City. <br />The City must make a determination that the request meets or does <br />not meet the criteria listed above and act accordingly. <br />MMH/BAC <br />Attachment <br />
