MEMO TO: Clerk -Administrator and City Council <br />FROM: Director of Public Works/Community Development <br />DATE: January 15, 1987 <br />SUBJECT: EXISTING DRIVEWAY RECONSTRUCTION (PROPOSED <br />ORDINANCE NO. 416) <br />As you may recall, Staff was requested to study the possibility <br />of allowing existing driveways to be reconstructed even if they <br />are non -conforming to the City Code' in relation tb"new driveway <br />construction. I have discussed the attached proposed Ordinance <br />No. 416 with Attorney Meyers. <br />The attached ordinance, if approved, would allow a property owner <br />to reconstruct or repair a non -conforming driveway to the <br />driveway's existing size and shape if the abutting property <br />owners that are directly affected by the non -conforming driveway <br />sign a petition stating, "we are aware that the abutting driveway <br />is non _conforming to existing City Code requirements and we have <br />no objection to the driveway being reconstructed or repaired to its <br />existing size and shape". <br />I look forward to discussing this issue with you on Tuesday <br />night, January 20, 1987. <br />SWT/bac <br />
