Mounds View City Council <br />Regular Meeting <br />^ October 12, 1987 <br />� Page Three <br />("".Clerk/Administrator Pauley reported work had been 9 <br />completed on judicial ditch #1, branch 5 restoration, <br />and asked authorization to pay the retainage of $926.07 <br />to the contractor, Park Construction. <br />Motion/Second: Quick/Blanchard to approve payment <br />of the retainage of $926.07 to Park Construction, for <br />work on judicial ditch #1, branch 5. <br />5 ayes 0 nays <br />Clerk/Administrator Pauley explained the purpose of <br />Ordinance No. 429. <br />Motion/Second: Blanchard/Wuori to have the sacend <br />reading and adoption of Ordinance No. 429, amending <br />Ordinance No. 419 vacating easements for the Jim Lund <br />Second Addition, and waive the reading. <br />Councilmember Quick - aye <br />Councilmember Hankner - aye <br />Councilmember Blanchard - aye <br />Ccuncilmember Wuori - aye <br />Mayor Linke - aye <br />Attorney Meyers reported a summons of compl-dnt has <br />been served on the City by Amoco oil Co., Sing <br />the Councils denial of a condition-1 use permit <br />for a gas station along Highway 10, at Silver Lake <br />Road. He reported the Council has had preliminary <br />discussions with he and Mark Harney, and the matter <br />has been referred to the City's insurance carrier. <br />He added he will be preparing a defense to the <br />lawsuit, as the Council has decided to vigorously <br />pursue it. <br />Motion/Second: Hankner/Wuori to authorize the City <br />Attorneys to prepare a defense in this lawsuit by <br />Amoco Oil Co. <br />5 ayes 0 nays <br />Councilmember Quick had no report. <br />Councilmember Hankner reported she had visited with <br />residents of Silver View Park regarding the path <br />that is to be constructed around the lake, and she <br />recommended that the path be delayed until engineering <br />studies have been done to determine where to place <br />the path, as there are problems in locating it. <br />Consideration <br />of Staff Memo <br />Regarding <br />Judicial Ditc: <br />#1, Branch 5' <br />Restoration <br />Motion <br />10.
