MEMO TO: Clerk -Administrator and City Council <br />FROM: City Planner Herman <br />DATE: October 15, 1987 <br />SUBJECT: CITY OF MOUNDS VIEW ZONING CODE INTERPRETATION <br />FOR B-2 ZONING <br />Tore Wistrom representing Kraus -Anderson has requested a code <br />interpretation for the permitted uses allowed within a B-2 <br />zoning. <br />A company named Subway has shown an interest in leasing one of <br />the spaces in Silver View Plaza. This type of company is a <br />submarine sandwich store which would do the majority of its <br />business as a carry -out facility though customers would come in <br />to pick up their food. Additionally, the shop would like to have <br />approximately 24 seats in the facility for those persons wishing <br />to consume their purchases on the premises. Currently, Subway is <br />lookino at an 11,000 s_uare fuot rental space. <br />The B-3 zoning allows as a permitted use "restaurants, cafes, <br />tea rooms, taverns, on- and off -sale liquor". Within a B-3 <br />zoning, drive-in and convenience food establishments are allowed <br />�. as conditional uses. As defined, convenience food establishments <br />are an establishment which serves food in or on disposable or <br />edible containers in individual servings fcr consumption on or <br />off the premises. <br />The following questions need to be addressed: <br />1. Does this sandwich shop fall under the definition of deli? <br />2. Does allowing minimal seati:.g negate this as a permitted <br />use in a B-2 zone? <br />3. What is the definition of a delicatessen? <br />4. What is the B-2 zoning trying to achieve in terms of <br />development goals. <br />KJH/bac <br />
