MEMO TO: MAYOR AND CITY COU CAL <br />di FROM: CLERK-ADMINISTRAT <br />DATE: APRIL 14, 1987 <br />SUBJECT: GASOLINE TANKS AT NON -OPERATING SERVICE STATIONS <br />At a recent Agenda Session, the issue of gasoline tanks at <br />service stations no longer in operation in the City was <br />raised with regard to whether or not the City has required <br />the owners of these facilities to fill or remove these <br />tanks. <br />In response to this inquiry, Staff consulted with <br />Mr. Tom Skeate, the Fire Department's Fire Marshall, to <br />determine what state regulations currently exist regarding <br />this matter. Fire Marshall Skeate indicated that any <br />gasoline tanks in the ground and not in continuous use must <br />be filled or removed pursuant to Fire Department and <br />Minnesota Pollution Control Agency Regulations. <br />To the best of our knowledge abandoned gasoline tanks do, or <br />could, exist at the following locations: <br />1) Steve's Appliance, 2841 T. H. 10 <br />2) Mid -American Auto, 2975 T. H. 10 <br />3) Quick Oil Change, 2848 T. H. 10 <br />4) St. Paul Rent All, 2190 T. H. 10 <br />Staff, at this time, is requesting direction from the <br />Council regarding two items related to this issue. First, <br />does the Council wish to have administrative proceedings <br />begun to order the filling or removal of gasoline tanks at <br />these four locations? Secondly, as this will be an <br />extremely expensive undertaking for any of these property <br />owners, is the Council prepared to go so far as court action <br />to require the filling or removal of these tanks? Should <br />Council respond in the affirmative to each of these two <br />questions, it is Staff's intention to request that the Fire <br />Department begin the proceedings necessary to order the <br />filing or removal of tanks at these locations that are <br />currently in violation of Fire Department and Minnesota <br />Pollution Control Agency Regulations.
