PLANNING CONSIDERATIONS
State Law now states that when the Comprehensive Land Use
Plan does not conform with the zoning on a piece of properly,
the City can only enforce the Zoning Code.
Approvals are needed from the Minnesota Department of
Transportation and Ramsey County for access to their road
right-of-way. Approval from Rice Creek Watershed District is
not necessary because the proposed commercial development is
less than 2-1/2 acres.
1. Setbacks - Proposed structures, fencing, paving and
cur meet minimum setback requirements.
2. Access - Applicant proposes two access points. One
from T.H. 10 and the other from Silver Lake Road. The
access points satisfy City requirements.
3. Parkin - City Code requires 13 total parking spaces (9
parking spaces for the retail store, plus 4 parking
.spaces for the motor fuel station). No additional
parking spaces are required for the car wash.
Applicant proposes 16 parking spaces (12 parking spaces
at the pump, 3 regular spaces and 1 handicapped parking
space). The proposed parking spaces satisfy City Code
requirements.
4. Magazining or Stacking Space - City Code 40.18, Subd.
D(2)b, states that magazining or stacking space must be
available for car washes to accommodate the number of
vehicles which can be washed during a maximum 30 minute
period and shall be subject to the approval of the City
Engineer. The applicant has not submitted stacking
space calculations yet. There appears to be space for
5 cars to wait for the car wash.
