PLANNING CONSIDERATIONS <br />State Law now states that when the Comprehensive Land Use <br />Plan does not conform with the zoning on a piece of properly, <br />the City can only enforce the Zoning Code. <br />Approvals are needed from the Minnesota Department of <br />Transportation and Ramsey County for access to their road <br />right-of-way. Approval from Rice Creek Watershed District is <br />not necessary because the proposed commercial development is <br />less than 2-1/2 acres. <br />1. Setbacks - Proposed structures, fencing, paving and <br />cur meet minimum setback requirements. <br />2. Access - Applicant proposes two access points. One <br />from T.H. 10 and the other from Silver Lake Road. The <br />access points satisfy City requirements. <br />3. Parkin - City Code requires 13 total parking spaces (9 <br />parking spaces for the retail store, plus 4 parking <br />.spaces for the motor fuel station). No additional <br />parking spaces are required for the car wash. <br />Applicant proposes 16 parking spaces (12 parking spaces <br />at the pump, 3 regular spaces and 1 handicapped parking <br />space). The proposed parking spaces satisfy City Code <br />requirements. <br />4. Magazining or Stacking Space - City Code 40.18, Subd. <br />D(2)b, states that magazining or stacking space must be <br />available for car washes to accommodate the number of <br />vehicles which can be washed during a maximum 30 minute <br />period and shall be subject to the approval of the City <br />Engineer. The applicant has not submitted stacking <br />space calculations yet. There appears to be space for <br />5 cars to wait for the car wash. <br />
