Mounds View City Council p ry —q,n� May 11, 1987 <br />t A�^ ry r i a A Page Pour <br />Regular Meeting E �.._: 4 <br />- - - - <br />Y L. <br />Motion/Second: Linke/Blanchard to have the portable <br />building moved to the well house location on the north <br />side of City Hall, with a final decision to be made in <br />two weeks, on May 26, 1987. <br />4 ayes 0 nays <br />Clerk/Administrator Pauley reviewed'the request for <br />a minor subdivision from Ted and Pamela Lautzenheiser, <br />8121 Long Lake Road, and the request of Marvin Kelly, <br />2521 Sherwood Road, for a minor subdivision in connec- <br />tion with the Lautzenheiser's subdivision. Re explained <br />the importance of approving both requests at the same <br />time, to insure the City does not create a land -locked <br />lot. Ile added the Planning Commission has reviewed <br />the requests and recommends approval. <br />Motion/Second: Quick/Wuori to approve Resolution <br />No. 2197, approving the minor subdivision of Ted and <br />Pamela Lautzenheiser, 8121 Long Lake Road, and Marvin <br />Kelly, 2521 Sherwood Road. <br />4 ayes 0 nays <br />Clerk/Administrator Pauley reported Staff is <br />working with the property owners along County Road I. <br />He stated that if a property owner should refuse to <br />provide the City with the needed right-of-way, it <br />could place the City in a difficult position due to <br />time constraints, and he asked the Council to authorize <br />the City Attorney to file for condemnation, if necessary. <br />Motion/Second: Quick/Blanchard to authorize the City <br />Attorney to file for condemnation of the needed <br />right-of-way for the reconstruction of County Road I, <br />should the City be unsuccessful in negotiating <br />acquisition of said right-of-way prior to June 1, 1987. <br />4 ayes 0 nays <br />Attorney Meyers advised that condemnation proceedings <br />would require the hiring of an appraiser. The Council <br />clarified that that would be within the authority of <br />the motion they had just passed. <br />Attorney Meyers reported that at the time of the <br />explosion last year, the City came into possession <br />of the pipeline, and Williams Pipeline Company <br />would like to have it moved to Naperville, <br />Illinois, for further research. Williams Pipeline <br />has brought forth a motion, which will be heard on <br />June 5 by Judge Diana Murphy regarding the moving <br />of the pipe, and the City will have a counter - <br />Motion Carried <br />8.
