City shall be Lite obligee for the use of the City to guarantee <br />performance by the Developer of all of the terms and conditions of <br />` this Contract, in conformance with its terms, and in addition, <br />upon Lite Developer conforming to the rules, regulations, statutes <br />and ordinances of the City and the Developer agrees that it shall <br />hold the City harmless from all costs and charges and damages that <br />may occur on account of doing of the work specified and for the <br />enforcing of the terms of this Contract• or bond, if action is <br />brought• hereon, including reasonable attorney's fees, in any case <br />where such action is successfully maintained and for the compliance <br />with the laws appertaining thereto, wherein the bond shall be void, <br />but otherwise shall remain in full force and effect. <br />15. It• is understood and hereby agreed by and between the <br />parties hereto that any plans or data supplied by the City within <br />or adjacent to said development site are approximations only and <br />that the•City explicitly does not pretend or guarantee or warrant <br />any such plans or data to be either complete or correct. <br />16. The Developer shall not unnecessarily create, cause or <br />suffer to exist or to continue to exist, any nuisance or hazard <br />to persons or property within or adjacent to said site by reason <br />of said public improvements, development of the site or other <br />operations in respect thereof or permit its agents, engineers or <br />contractors to do so. <br />17. When applicable, three complete sets of plans and speci- <br />fications or directions for any public improvement to be constructed <br />on said site, each bearing the certificate and seal of a professional <br />engineer duly registered in the Stale of Minnesota, shall be sub- <br />mitLed to the City well in advance of: the Lime proposed for commenc- <br />ing construction thereof.
