l., MEMO TO: MAYOR AND CITY COUNCIL <br />FROM: CLERK -ADMINISTRATOR ` <br />DATE: JULY 29, 1907 <br />SUBJECT: MID AMERICAN AUTO USED AUTO SALES LICENSE <br />TRANSFER <br />Mr.. Kevin Mullins of Lino Lakes has entered into an earnest <br />money agreement with Mr. Joseph Cox, current owner of Mid <br />American Auto at 2975 Trunk Ilighway 10 to purchase this <br />facility and operate a used auto sales lot at the location. <br />The City's current zoning code provides that new and used <br />auto sales are a principle permitted use in B-3 zoned <br />property which is the current zoning for this property. <br />Therefore, the Conditional Use Permit required of <br />Mr. Cox at the time he opened up his business cannot be <br />required of Mr. Mullins due to the change in the zoning <br />code. <br />A review of Chapter 109 of the Municipal Code, copy <br />attached, indicates that, "The Council may impose any <br />conditions or restrictions it deems necessary or adviseable <br />in the public interest in the motion granting any license <br />hereunder. (used auto license), including but not limited to, <br />conditions relating to the hours of operation, the lighting <br />of the business and the installation and maintenance of <br />shrubbery, fencing, and grounds around the business." <br />Chapter 109 also provides that the Council may hold a public <br />hearing prior to action on an application for a used auto <br />sales license. <br />Also attached is a copy of. a site plan provided by <br />Mr. Mullins indicating how he proposes to provide for <br />customer parking as well as the location of used car <br />parking. <br />in reviewing the application and the problems we have <br />previously experienced on this site, staff would recommend <br />that the following restrictions be placed upon the operation <br />Of a used auto sales lot on this site should the Council <br />deem it appropriate to issue a .license to Mr. Mullins. <br />1. The entire lot: where customer and used vehicle <br />parking is located must be paved and striped. <br />2. No outside storage of parts, supplies, equipment, <br />or any other items other than autos for sale. <br />3. Vehicle mai.ntenanre and repair shall be limited to <br />minor repairs on vehicles to be sold on the lot with <br />said repairs limited to minor body and fender work, <br />minor painting and npholster.ing service, replacement <br />of. parts and engine service to passenger vehicles <br />and trucks not exceeding a 1 ton chassis design. <br />
