herein pursuant to the terms of this development contract, and <br />said Developer shall not permit the premise3 to deteriorate or <br />become blighted or t, constitute a public nuisance. Enforcement <br />of this provision shall be pursuant to the terms of this contract <br />_- <br />or the provisions of the applicable Minnesota Statutes, the <br />Mounds View Home Rule Charter, and the Municipal Code. In the <br />_- <br />event of nonconformance by the Developer, the City shall seek <br />mandatory relief, after written notice of the alleged violations, <br />pursuant to the terms of this contract to enforce this provision <br />and may proceed to abate public nuisances and to assess the cost <br />of said abatement, including all costs, disbursements, legal fees <br />Y. <br />against the development site, as provided for in the Home Rule <br />Charter, Chapter 26 of the Municipal Code, and such other appli- <br />cable ordinances and Minnesota Statutes. The Developer's obliga- <br />tions under this paragraph shall immediately terminate, with <br />respect to the Developer, upon the Developer's transfer or <br />conveyance of its entire '.nterest in the development site <br />provided the successor or assignee assumes bai9 oL-.igations. <br />18. The development site shall be developed as indicated <br />on the attached site plan, referred to as Exhibit 1. The site <br />plan'and the development to be constructed thereon may be <br />amended from time to time by the mutual -itten consent of the <br />parties hereto, in conformance with the Municipal Code of the <br />city. <br />19. In addition to all of the provisions recited herein - <br />before, the Developer agrees to the following conditions as more <br />fully set out in Exhibit 2A attached hereto and made a part <br />hereof. <br />- o - <br />
