ARTICLE I <br />Definitlons <br />Section I.I. Definitions. In this Agreement, unless a different meaning <br />clearly appears from the context: <br />"Act" means the Municipal Development Districts Act, Minnesota Statutes, <br />Sections 469.124 to 489.134, as amended. <br />"Agreement" means this Agreement, as the same may be from time to time <br />modified, amended, or supplemented. <br />"Assessed Market Value' nr "Assessed Market Valuation" means the market <br />value of real property as determined by the county assessor of the County in <br />accordance with Minnesota Statutes, Section 273.11 (or as finally adjusted by any <br />assessor, board of equalization, commissioner of revenue, or any court). <br />"Assessment Agreement" means each agreement, in the form of the agree- <br />ment contained in Schedule C attached to and made a part of this Agreement, <br />among the Redeveloper, the City, and the county assessor of the County, entered <br />Into pursuant to Section 6.4 of this Agreement. <br />"Assessor's Minimum Market Value" means the agreed minimum market <br />value of any Phase of the Redevelopment Property for calculation of real property <br />taxes as determined by the county assessor for the County pursuant to the <br />Assessment Agreement. <br />"Bonds" means the bonds or other obligations Issued by the City to finance <br />Its acquisition of the Redevelopment Property, construction of the Public <br />Improvements, and its other costs hereunder (and costs related to such acquisition <br />and construction). The term "Bonds" shall also include any bonds or obligations <br />Issued to refund any Bonds. <br />"Certificate of Completion" means the certification, in the form of the <br />certificate contained in Schedule D attached to and made a part of this <br />Agreement, provided to the Redeveloper, or the purchaser of any pert, parcel or <br />unit of the Redevelopment Property, pursuant to Section 4.4 of this Agreement. <br />"City" means the City of Mounds View; Minnesota, or its successors or <br />assigns. <br />"Construction Plans" means the plans, specifications, drawings and relates. <br />documents on the construction work to be performed by the Redeveloper on the <br />Redevelopment Property which (a) shall be as detailed as the plans, specifications, <br />drawings and related documents which are submitted to the Building Official of the <br />City, and (b) shall include at least the following for each building. (1) site plan; (2) <br />foundation plan; (3) basement plans; (4) floor plan for each floor; (5) cross sections <br />of each (length and width); (6) elevations (all sides, except as to a side of existing <br />structure where no construction is to take place), (7) facade and landscape plan; <br />and (8) such other plans or supplements to the foregoing plans as the City may <br />reasonably request. <br />
