He asked the Council to authorize
the Mayor and Treasurer to make a check paya.,le to
the Clerk of District Court, in the amount of
$76,900, for the right-of-way. He added that after
the deposit is made, and the appropriate procedures
followed, the property will become the City's.
Clerk/Administrator Pauley reviewed the case of the
acquisition of property from Russ Underdahl, which
is being handled by Attorney Mark Karney. He stated
Mr. Underdahl is debating the appraised value of the
property, which is $20,000. The funds for the
acquisition would come from the special projects
fund, and would be returned, with lost interest,
after the tax increment financing has been completed.
He explained both the City and developer had tried
extensively to negotiate a price with both owners
but were not able to come to an agreement.
Attoxnev Meyers reviewed how the interest would be
disbersed on the funds deposited with the Court
and he clarified that the interest would go to th-
owners of the property.
December 14, 1987
Page Eleven
Motion Carrie,
15.
