MEMO TO: CLERK -ADMINISTRATOR, MAYOR AND CITY COUNCIL <br />(`- FROM: CITY PLANNER KIM HERMAN <br />DATE: JANUARY 14, 1988 <br />SUBJECT: DAILEY KNOLLS FINAL PLAT APPROVAL AND EXTENSION <br />Attached you will find a copy of the letter sent to the City <br />Council requesting an extension for Dailey Homes, Inc. to <br />submit their final plat for approval. Chapter 42.05, Subd. <br />3 (1) states that the subdivider will file 12 copies of the <br />final plat no later than six months after the date of <br />preliminary plat approval, otherwise the preliminary and <br />final plat will be considered void unless an extension is <br />requested by the subdivider and for good cause granted by <br />the Council. The preliminary plat was approved May 26 by± <br />the Council which makes this filing approximately 1 1/2 = <br />months late. <br />There did seem to be some confusion cn the subdividers part <br />regarding the subdivision process. Apparently, he thought <br />the preliminary plat approval was all that was needed to <br />subdivide his property although he was no!i.fied otherwise on <br />several occasions by the City. <br />The final plat has been reviewed by City staff and the City <br />Engineer to determine conformity to the preliminary plat. <br />The need for classification on some of the issues related to <br />the extension of utilities (sewer anJ water) to the <br />properties will be discussed in the development agreement. <br />The final plat has been found to be in conformance with the - <br />preliminary plat per 42.05, Subdivision 3. <br />RECOMMENDATION: Staff recommends granting of the extension { <br />and fib a1 plat approval of the Dailey Knolls plat. <br />KH/mjs <br />
