W <br />DRAFT <br />RESOLUTION NO. 2327 <br />CITY OF t10UNDS VIE17 <br />COUNTY OF RAMSEY <br />STATE Or MINNESOTA <br />RESOLUTION DENYING VARIANCE APPEAL FOR DYNAtt'C DESIGNERS, <br />7656/7660 WOODLAWN DRIVE, HOUNDS VIEW PLANNING CASE NO. 138-83 <br />WHEREAS, Dynamic Designers have requested an appeal from a <br />variance denial to build two fourplexes at the properties <br />commonly known as 7656/7660 Woodlawn Drive; and <br />WHEREAS, there is a discrepancy between the lot size <br />scaled off on the site plan dated January 12, 1988, and that of <br />the Ramsey County records; and <br />WHEREAS, the ex?.sting proposal would require the following <br />approvals: <br />1) Waive the minimum lot size for subdivision in a <br />wetland zoning district. <br />2) Waive the minimum lot width as measured at the <br />building setback line for subdividing within a wetland <br />zoning district. <br />3) Waive the requirements that all structures shall be <br />set back at least 100 feet from a designated wetland. <br />4) The existing proposal needs a conditional use permit <br />for filling within a flood plain. <br />5) The existing proposal requires a wetland alteration <br />permit to change the wetland boundaries. <br />WHEREAS, Staff, City Consultants, Planning Commission and <br />City Council have extensively reviewed the proposed development; <br />and <br />WHEREAS, the City Council does not find any extraordinary <br />circumstances as presented which apply to ;he property which do <br />not apply to other properties in a wetland zoning district and, <br />therefore, cannot grant a variance from the minimum lot size <br />within a wetlar:d; and <br />WHEREAS, the City Council does not find any ext.aordinary <br />circumstances as presented which apply to the property which do <br />not apply to other properties in a wetland zoning district and, <br />therefore, cannot grant a variance from the minimum lot width as <br />measured at the building setback line for subdividing within a <br />wetland; and <br />
