9� 5 <br />MEMO TO: MAYOR AND CITY COUNCIL <br />FROM: CLERK -ADMINISTRATOR <br />DATE: MAY 24, 1988 <br />SUBJECT: ORDINANCE NO. 434 AMENDING CHAPTER 1.11 OF THE. <br />MOUNCS VIEW MUNICIPAL CODE <br />As you may recall, in the past the City Council has <br />considered Ordinance No. 434 Amending Chapter 1.11 of the <br />Municipal Code which lists the municipal employees who are <br />not licensed peace officarc and who are authorized to issue <br />citati,)ns or Administrative Offenses. The Council found the <br />Ordinance prepared by City Staff to be unacceptable in its <br />original form and referred the matter to the City Attorney <br />for reviaw and preparation of a modified ordinance. <br />Attached please find a memorandum from City Attorney Richard <br />Meyers and an amended Ordinance No. 434. Attorney Meyers <br />has underlined the title of the employee he feels should <br />be authorized to issue citations for thA specific chapters <br />of the Municipal Code listed. Mr. Meyers also suggests that <br />an additional paragraph be added to Ordinance No. 434 as <br />part of Section I. This new paragraph would read as <br />follows: <br />'In the event that the position of a non -peace officer <br />employee is vacant, then the Clerk -Administrator is <br />authorized to issua citations as provided for in this <br />Subdivision B." <br />Should Council find that revised Ordinance No. 434 is <br />acceptable, it will be prepared in final form for your <br />adoption. Should Council not find this revised Ordinance <br />No. 434 to be satisfactory, Staff would request your further <br />direction in this matter. <br />DFP/MJS <br />@' <br />
