ME140 TO: MAYOR AND CITY COUNC <br />FROM: CLERK-ADMINISTRAT <br />a <br />DATE: MAY 24, 1988 <br />SUBJECT: BEL-RAE BALLROOM STRONG BEER LICENSE <br />Attached please find a note from Tony Jambor of the Bel -Rae <br />Ballroom requesting that the City issue a strong beer <br />license to him based on the fact that his sales of food <br />exceed 60% of his total receipts. Also attached please find <br />a photocopy of Minnesota Statutes 340A.404, Subdivision 5, <br />(b) which states, <br />"The governing body of a municipality may by ordinance <br />authorize a holder of an on -sale wine license issued <br />71 <br />pursuant to paragraph (a) who is also licensed to <br />sell non -intoxicating male liquors at on -sale pursuant <br />to section 340A.411, and whose gross receipts are at <br />least 60% attributable to the sale of food, to sell <br />intoxicating malt liquors at on -sale without an <br />additional license." <br />The Bel -Rae Ballroom is currently licensed for the on -sale <br />of wine and non -intoxicating malt liquors. Due to the <br />information provided by Mr. Jambor and certified to by his <br />accountant, the City would be in a position to adopt an <br />ordinance authorizing him to sell intoxicating malt liquors. <br />Should it be the desire of the City Council to comply with <br />Mr. Jambor's request, Staff would request the Council direct <br />that the City Attorney prepare an ordinance allowing for the <br />Bel -Rae Ballroom to .sell intoxicting malt liquors. <br />DFP/MJS <br />
