SEXUAL HARASSMENT POLICY <br />PAGE FOUR <br />of the employee, and any other factors the City <br />Council believes relate to fair and efficient <br />administration of the City, including but not <br />limited to the affect of the offense on the <br />employee morale, publ.ic perception of the offense, <br />and the light in which it casts the City. The <br />disciplinary action may include demotion, <br />suspension, dismissal, warning or reprimand. A <br />determination of the level of disciplinary action <br />shall also be made on a ease -by -case basis. <br />A written record of disciplinary action shall be <br />kept, including verbal reprimands. <br />In all events, an employee found guilty of sexual <br />harassment shall be warned not to <br />retaliate <br />in of any <br />r <br />way against the person making complaint <br />sexual harassment, witnesses or any other persons <br />connected with the investigation of the complaint <br />of harassment. <br />(a) The investigation, discipline and disposition <br />of a sexual harassment complaint against a <br />member of the City's Police Force shall be <br />governed by Department Policy Section 30. <br />(b) Upon receipt of a report on the investiga- <br />tion of a complaint of sexual harassment <br />against the Clerk -Administrator, the City <br />Attorney shall present the report .j the <br />City Council. If. the City Attorney determines _ <br />that the complaint of sexual harassment is <br />founded, the City Council may discipline the <br />Clerk -Administrator consistent with its <br />authority under the Municipal Code, Charter, <br />ordinance, resolutions or rules governing <br />discipline of the Clerk -Administrator. <br />(c) The City Council may discipline an elected <br />official in whatever manner it deems <br />appropriate, consistent with its authority <br />under state law, the municipal charter, <br />ordinances, resolutions or other rules <br />governing discipline of elected officials. <br />(d) In cases of sexual harassment committed by <br />a non -employee against a City employee in <br />the workplace, the Clerk -Administrator shall <br />take all lawful steps to ensure that the <br />sexual harassment is brought to an immediate <br />and. <br />
