U&I llv� 9 <br />MEMO TO: MAYOR AND CITY COUNC <br />00 FROM: CLERK -ADMINISTRATOR <br />DATE: JULY 13, 1988 9 <br />SUBJECT: OCCUPANCY PERMIT - MOUNDS VIEW BUSINESS PARK <br />BUILDING A <br />The construction of Building A also known as the Clinch - <br />On building in Mounds View Business Park has been completed <br />and the developer, Everest Construction Company, has <br />requested that the City issue an Occupancy Permit. <br />As a result of this request, I requested that Building <br />Official Jim Tobias and City Planner Kim Herman inspect the <br />project and determine whether or not it is in compliance <br />with the plans and specifications submitted and approved as <br />part of the Development Agreement. This inspection resulted <br />in a determination that the building was completed per the <br />plans and specifications, however, not all trees had been <br />planted pursuant to these plans and the sodding of the banks <br />of the storm water retention pond on the east side of the <br />site had not occurred. Attached please find a memorandum <br />from Building Official Jim Tobias indicating the current <br />status of the construction of the building. <br />��. In response to our determination that the project was not <br />completed per plans, Mr. Rick Baker of Everest Construction <br />advised the City by letter, copy attached, that the <br />boulevard trees had initially been proposed to be planted at <br />30 feet off center but that the landscaper for the project <br />felt that the spacing would be too close and the plans were <br />changed to 40 feet on center resulting in a net shortfall of <br />11 trees. Mr. Baker proposes that once the entire project is <br />completed, Everest would be willing to plant additional <br />trees around the ponds and along Highway 10 to compensate <br />for these adjustments. Mr. Baker also advises that due to <br />the current dry weather sodding of the banks of the storm <br />water retention pond was determined to be inadviseable and <br />that they will agree to complete the sodding by October 1st <br />of this year. <br />In light of this information and the promisory statements <br />made by Everest Construction regarding the two <br />inconsistencies, Staff recommends that the Council authorize <br />the issuance of an Occupancy Certificate for. Building A with <br />the following contingencies. <br />1. The sodding of the banks of the storm water <br />retention pond on the east side of the building be <br />completed by October 1st of this year. <br />
