PUBLIC HEARING: Second Reading and Approval of Ordinance 1045, 6 <br />Amending Mounds View City Code 160.088 related to Accessory Dwelling 7 <br />Units ROLL CALL VOTE. 8 <br /> 9 <br />Evan Monson, Stantec, requested the Council hold the second hearing and approve Ordinance 10 <br />1045 relating to accessory dwellings. He explained the Council reviewed this matter at a 11 <br />worksession meeting and the Planning Commission reviewed this matter at their meeting on July 12 <br />2. He summarized the proposed changes noting he had spoken to public works about shared 13 <br />water/sewer connections being privately maintained. He stated if the Council supported the shared 14 <br />water/sewer connection language, he would recommend the Council table action on this item to 15 <br />allow staff to revise the language further. 16 <br /> 17 <br />Council Member Smith reviewed the definition of a short-term rental and asked if the City would 18 <br />allow an ADU to be rented for two months. Mr. Monson reported this would be allowed. He stated 19 <br />the Council could further review the short-term rental language within City Code. 20 <br /> 21 <br />Mayor Lindstrom explained the 30-day requirement was put in place to curb weekend or week-22 <br />long rentals. He stated he did not believe rentals more than 31 days were a concern in the City. He 23 <br />understood that snowbirds rented out their homes during the winter months and this was allowed 24 <br />per City Code. He questioned if the City has identified a specific type of housing that was not 25 <br />allowed in specific locations, would this open the City up for liability. City Attorney Riggs advised 26 <br />this was a distinct and unique use from an overall use in the community. He indicated the City 27 <br />Council could talk about putting a robust rental licensing program in place. 28 <br /> 29 <br />City Administrator Zikmund reported the recommendation from staff was to table action on this 30 <br />item and staff could bring back a short-term rental definition for further discussion. 31 <br /> 32 <br />City Attorney Riggs recommended the Council open and continue the public hearing for this item. 33 <br /> 34 <br />Council Member Clark inquired if a rental license would be required if a family member was living 35 <br />in the ADU. City Administrator Zikmund suggested the City Council discuss this topic further at 36 <br />an upcoming worksession meeting. 37 <br /> 38 <br />Mayor Lindstrom opened the public hearing at 6:16 p.m. 39 <br /> 40 <br />Rebecca Scholl, 2467 Hillview Road, asked if a snowbird would be allowed to build an ADU and 41 <br />could then rent both units during the winter months. She inquired if sewer lines would have to be 42 <br />updated at the time an ADU was constructed. She reported she used to manage rentals in Mounds 43 <br />View. She indicated she did not support one-month rentals, because this was not a long enough 44 <br />commitment. She suggested rentals be at least 90 days. 45 <br /> 46
