that have shared their displeasure with the overall appearance of the Gunn property, how <br /> nothing has changed for a decade, and that its condition casts a negative light onto the <br /> surrounding area and community. <br /> Lastly, there is a residential group home adjacent to the Gunn property that is operated <br /> by the State of Minnesota. During a recent site visit and inspection by State Officials' <br /> concerns were shared with City staff that the Gunn property was an attractive Nuisance <br /> presenting a risk to the vulnerable adult group home occupants. <br /> Council has three remedies to address the situation: abatement, civil penalties via <br /> Administrative Citation, and criminal charges. The abatement process gives staff legal <br /> authority to enter the property remove the "junk" materials and place the artificial flowers <br /> and landscaping items into a secure storage location to be reclaimed by the owner upon <br /> payment of collection and storage fees. All costs of the action would be then billed to the <br /> property owner. Failure to pay would result in assessment directly to the property. <br /> Council can also direct staff to initiate a civil penalty with the City administrative citation <br /> for property-based violations. The 2025 fee schedule established a $150 penalty for <br /> property-based violations and a $300 penalty for the second offense within 12 months. If <br /> Civil penalties remain unpaid the City has the ability to certify to them to the property <br /> taxes. <br /> Lastly, the Council could direct staff to initiate criminal charges which would occur through <br /> our prosecuting attorney. Ordinance violations are a misdemeanor under State Statute <br /> and have a maximum penalty of $750 and 90-days confinement, although staff <br /> experience is Ramsey County District Court sentence guidelines do not impose <br /> confinement, and penalties are generally minimum plus court costs totaling $150. <br /> Strategic Plan Strategy/Goal: <br /> A progressive city that is welcoming and desirable destination to all ages and cultures, <br /> who seek progress through partnership, and a place where residents can live, work and <br /> play safely and show pride in the community. <br /> Financial Impact: <br /> $3,000 to $5,000 in legal fees, clean-up and storage fees. <br /> The Mounds View Vision <br /> A Thriving Desirable Community <br />
