Sathe, Legal Counsel <br /> RE: PUBLIC HEARING: Proposed Amendments to the Mounds View City Charter <br /> Regarding Appointments—Introduction and First Reading of Ordinance 1050 <br /> The Mounds View Charter Commission recommends that the City Council amend the Mounds View <br /> City Charter by ordinance to address the process for making appointments in the case of a mayoral or <br /> councilmember vacancy. The amendment includes a set process, timeline, and eligible appointees. <br /> Additionally, the amendment provides that a person appointed as mayor would not preside of council <br /> meetings or give the state of the City address — these functions could be performed by the <br /> councilmember designated as Acting Mayor at the first meeting of the year. <br /> This proposal is similar to an amendment presented in the fall of 2024, but which was amended to <br /> address legal concerns with the language, and it is identical to the amendment presented in the fall of <br /> 2025 but has been presented again for adoption due to a timing error. <br /> AMENDMENTS TO CHAPTER 4 <br /> The proposed appointment process is slightly different depending on the timing of the vacancy: <br /> 365 Days or More Remaining in Unexpired Term—Section 4.05, subd. 1 <br /> If there are 365 days or more remaining in an unexpired term: <br /> - The City Council may appoint an individual using the new appointment process. <br /> - The appointee serves until a successor is elected at a special election. <br /> - A special election is called for the next feasible statutorily designated uniform election date <br /> (occurring the second Tuesdays in February, April, May, and August and the second Tuesday <br /> after the first Monday in November). <br /> Less than 365 Days Remaining in Unexpired Term—Section 4.05, subd. 2 <br /> MU210\4\1059035.vl <br />
