thereto to qualify, or by reason of the death, resignation in writing filed with the city <br /> administrator, removal from office, non-residence in the city, conviction of a felony of <br /> any such person after their election, or by reason of the failure of any Council member <br /> without good cause to attend Council meetings for a period of three (3) consecutive <br /> months. In each such case the Council shall <br /> follow the appointment process in Chanter 4, Section 4.05. <br /> 2.02. Chapter 4 of the Mounds View City Charter is hereby amended by removing Section 4.05 in its <br /> entirety and replacing it with the following: <br /> Section 4.05 Vacancy in Municipal Elected Office <br /> Subdivision 1. Vacancy and 365 days or more remain in term. The following timelines <br /> shall be followed when addressing a vacancy in an elected office of the City that occurs <br /> with 365 days or more remaining in the term of the vacated office: <br /> A) A special election shall be called at the next uniform election date specified in <br /> Minnesota Statutes, section 205.10, subd. 3a, for which all legal requirements for special <br /> elections can be met by the City. <br /> [OPTION 1 —Recommended Language] <br /> B) The City Council shall appoint an individual following the appointment process in <br /> this Section 4.05 to fill the vacancy until a successor is elected and qualifies. <br /> [OPTION 2 — Language based on 2024 Proposal] <br /> B) If the date of the vacancy is more than 130 days from the date of the next eligible <br /> election the City Council must follow the appointment process in this Section 4.05 to fill <br /> the vacancy until a successor is elected and qualifies. No appointment may be made if the <br /> next eligible special election date is 130 or fewer days from the date of the vacancy. <br /> Subdivision 2. Vacancy and less than 365 days remain in the term. The following <br /> timelines shall be followed when addressing a vacancy in an elected office of the City <br /> that occurs with less than 365 days remaining in the term of the vacated office: <br /> [OPTION 1 —Recommended Language] <br /> A) The City Council shall appoint an individual following the appointment process in <br /> This Section 4.05 to fill the vacancy for the remainder of the unexpired term and until the <br /> election and qualification of a successor. <br /> [OPTION 2—Language based on 2024 Proposal] <br /> A) If the date of the vacancy is more than 130 days before the regular municipal <br /> election, then a special election shall be called to coincide with the regular municipal <br /> DOCSOPEN\MU210\4\1025877.v2-5/2/25 <br />
