76.01 Granting to Northern Sates Power Company, a Minnesota corporatio'l,
its successors and assigns, permission to conduct, operate, repair, and maintain,
in the_ City of l-lounds View, mnnesota, an electric distribution system and
transmission lines, including necessary poles, pole lineS, and fixtures and
~urtcnanccs: for the furnishing of electric energy to the City and its
inhabitants, ~nd others, and to use the strcets, alleys, public ways and public
grounds of said City for such purposes,
SECTION 1. Definitions.
Subd~ In this ordinance "City", "City Council" and City Clerk" me:)n, ,

and the Clerk of the City of Nounds View.
If at any time the powers :Jf the City, the City Council or the City Clerk

SECTION 12. Pranchis= Fcc.
It is agreed hy the City and Compan)" that the City may at any time during
the term hen'of imposp. on the Compan)', as full compensation fot' thc rights hereby
erllnt.,,J, a franchise fee of not more than four percent (4%) of thc Company's gross
oper..ti ng revenues, as here\nafter defined, such fee to be payable not latcr
than April I, of cneh year and to be based upon the gross operating rcvenues of
the Company for the preceding calendar year or the part thereof after such fee
becomes effective. Such fee shall be imposed by ordinance duly adopted by a
four-fifth's vote of the entjre Council, after a public hO:11'ing, pursuant to
notice published ill the official newspaper, providing for at least ten (10)
days' notice prior to the hearing, and shall not become effective until at least
sixty (GO) d~Y5 after written notice thereof has been served upon the Company
by r~gistered mail. The percent fee may be changed by the Council by ordinance
from time to time, however, each change shall meet the above notice. hearing,
and voting rcqu~rcmonts and the percentage imposed must remain fitm for at least
one year, and the total fee shall not exceed four percent. Such ordinance shAll
not prevent the Company from adjusting its charges in such manner as it deems'
appropl'iate for the purpose of reimbursing the Company for the payments to be
made to the City, afld the Company may indicate on its bills the customers'
portion of said fees. Such fee shall not exceed any amount which the Company
may legally recover prior to the payment to the City b)' imposing a surcharge
equivalent to such fee in its rates for electrical service to customers within
the City. The term "gross operating revenues" means all sums, excluding said
~u~charge: received by the Company from the sale of electricity within the
corporate limits of the City. The foregoing time and manner uf collecting said
surcharge is subject: to the approval of the t-!innesota Public Service Commission
which the Company ar.rees to use its best efforts to obtain.
