CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
AN ORDINANCE RELATING TO THE PROCEDURE FOR SHUTTING OFF
WATER SERVICE FOR DELINQUENT ACCOUNTS AND AMENDING TITLE
900, CHAPTER 906, SECTIONS 906.11 AND 906.13 OF THE
MOUNDS VIEW CITY CODE
THE CITY OF MOUNDS VIEW ORDAINS:
section 1. Section 906.11, Subdivision 2, of the Mounds
View City Code is amended to read:
Subd. 2. Shut-Off by ci ty-Grounds: Water service to a
property may be shut off by the City for the following reasons:
a) Violation of a provision of this code relating to the
operation, maintenance or connection to the water system.
b)
Fraud or misrepresentation by an owner or occupant in
connection with an application for service.
c)
Failure of an owner or occupant or to pay rates and
charges for water service when due.
Sec. 2. section 906.11 of the Mounds View city Code is
amended to add the following subdivisions:
Subd. 3. Shut-Off Procedures. If the City Administrator
determines that grounds exist for shutting off
water service, the administrator must notify the
owner or occupant of the City's intent to shut off
by mailed written notice not less than ten (10)
days prior to the date of shut-off. The notice
must state the reason for shutting off the water
service, the date that the water shut-off will be
effective and that the owner or occupant may
request a hearing before the City Council and that
at the hearing, the owner or occupant may present
testimony as to why the service should not be shut
off. The request for a hearing must be presented
in writing to the City Administrator not later than
the tenth day after mailing of the notice. A

sufficient to require the hearing. If a request
for a hearing is received, the City Administrator
may not shut off service until the hearing has been
held and then only at the direction of the City
Council. If a request for hearing is not timely
received, the City Administrator may shut off the
water service as of the date specified in the
notice.
Subd. 4. Emergency Shut-Off: The procedure in subdivision 3
does not apply to water shut-off in case of an
emergency.
Sec. 3.
section 906.13, Subd. 7, of the Mounds View
Municipal Code is amended to read:

Subd. 7. Delinquent Bills; Lien: In the event a water or
sewer bill is unpaid by the due date, a reminder
notice shall be sent to the customer. If payment
in full is not received by the City within (10)
days after the reminder notice is sent, the bill
shall be considered delinquent, and the service may
be discontinued as provided in section 906.11 and
the Council may cause the charges noted in such
billing to become a lien against the property
served by certifying to the County the amount of
said delinquent bill.
Sec. 4.
This ordinance is effective 30 days after its
publication.
