ORDINANCE NO. 439 1 .- (("" -- CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA AN ORDINANCE AMENDING THE MUNICIPAL CODE OF MOUNDS VIEW BY AMENDING CHAPTER 202 ENTITLED, "SNOWMOBILES" The City Council of the City of Mounds View does hereby ordain: SECTION I. Chapter 202.02 is amended as follows: 202.02 Limitation of Operation. No person shall operate a snowmobile in Mounds View except eft-~tle~fe-e~af~s, waee~ways-afte-se~eees-afte-ftf~ftways-s~eefffea~~y-eesf~ftaeee-- fe~-stleft-tlse. ..!.... l. On any privately owned land with the express permission of the property owner. 2. In an emergency during the period of time when and at location where the condition of the roadway renders travel by automobile impractical. . 3. By City Maintenance personnel and members of the City Police Force in the performance of their duties. No person shall operate a snowmobile in the City of Mounds View upon the paved portion or boulevard of any trunk r highway, county road or municipal street. SECTION II. Chapters 202.04, 202.05, 202.06, 202.07 and 202.08 shall be deleted. SECTION III. Chapter 202.04 is to be added and is to read as follows: 202.04 Penalties. Any person who violates any of the provisions of this Ordinance, Minnesota Statutes 84.81 to 84.90, or the Regulations of the Commissioner of Natural Resources N.W. 51 to 59, shall be guilty of a misdemeanor. SECTION IV. Chapter 202.05 is to be added and is to re ad as follows: 202.05 Repeal. This ordinance upon promulagation repeals all pre-existing regulations in force, except that such regulations shall be deemed to be in force for the purpose of perfecting any right vested, accrued or arising therefrom. SECTION V. Chapter 202.06 is to be added and is . to read as follows: 202.06 Separability. The provisions of this ordinance shall be separable and the invalidity of any section, paragraph, subdivision or other part thereof shall not make void, impair, invalidate or affect the remainder thereof.
