HomeMy WebLinkAboutOrdinance 765SUMMARY • ORDINANCE N0.765 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA AN ORDINANCE VACATING EXCESS RIGHT OF WAY AND EASEMENTS ASSOCIATED WITH THE MEDTRONIC CRM PLAT On November 14, 2005, the Mounds View City Council adopted an ordinance which vacates excess and unnecessary drainage easements and unimproved right of way associated with the Medtronic development on the former Bridges golf course site, north and west of Trunk Highway 10 and Interstate 35W. Kurt Ulrich, City Clerk-Administrator • • ORDINANCE NO. 765 • CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA AN ORDINANCE VACATING EXCESS RIGHT OF WAY AND EASEMENTS ASSOCIATED WITH THE MEDTRONIC CRM PLAT WHEREAS, there are easements and right of way previously platted and dedicated to the City of Mounds View within the Medtronic CRM plat that are excess and unnecessary, all legally described as follows: 1. All of the drainage easement across Outlot A as dedicated in NORTHSTAR INDUSTRIAL PARK 2ND ADDITION, Ramsey County, Minnesota. 2. All of the drainage easement and all of the drainage and utility easement as dedicated in Lot 4, Block 1, NORTHSTAR INDUSTRIAL PARK 2ND ADDITION, Ramsey County, Minnesota. 3. That part of the street easement across the west 33.00 feet of the South Half of the Northeast Quarter of Section 05, Township 30, Range 23, Ramsey County, Minnesota, which lies northerly of the northerly right of way line of U.S. Highway No. 10, as described in document number 1714471 as found in the office of the Ramsey County • Recorder. 4. Those parts of Ardan Avenue, Edgewood Drive and Jackson Drive as dedicated in LAPORT MEADOWS, Ramsey County, Minnesota, which lie northerly of the northerly right of way line of U.S. Highway No. 10. 5. The drainage easement across the north 50.00 feet of Lot 1, Block 1 and across the north 5.00 feet of Lot 15, Block 1, all in LAPORT MEADOWS, Ramsey County, Minnesota, as described in document number 1670999. WHEREAS, it has been determined that the above-described drainage, utility and right of way easements, as shown on attached Exhibit A, no longer serve a public purpose and it is in the public interest to vacate such unneeded drainage, utility and right of way easements. NOW THEREFORE, THE CITY OF MOUNDS VIEW ORDAINS: SECTION 1. The City of Mounds View Municipal Code Appendix D is hereby amended to include reference to the following Special Ordinance No. 765. Subd. 1. The City has made a determination that the above-described drainage, utility and right of way easements no longer serve a public purpose, and as such, it is in the public . interest to vacate such areas. Ordinance 765 Page 2 • Subd. 2. There are no public utilities, buried or otherwise, within the easements to be vacated except those to be protected by easements dedicated with the proposed Medtronic CRM plat. Subd. 3. The City Council of the City of Mounds View finds that there is no public interest or purpose served in retaining the excess and unneeded drainage, utility and right of way easements proposed for vacation. Subd. 4. The drainage, utility and right of way easements legally described herein and shown on Exhibit A are hereby vacated. SECTION 2. This ordinance takes effect thirty (30) days after its publication. First read by the City Council of the City of Mounds View this 10th day of October, 2005.
