STATE OF MINNESOTA
ACCEPTING BID PROPOSAL FROM MAX STEININGER, INC. FOR THE COUNTY
ROAD 10 TRAIL SEGMENTS 1-5 PROJECT AND AUTHORIZING THE
PREPARATION AND EXECUTION OF THE AGREEMENT FOR CONSTRUCTION
CONTRACT
WHEREAS, construction of County Road 10 Trail Segments 1-5 is an Action
Step for Goal 2 -County Road 10 Redevelopment and Revitalization of the City's
adopted 2008-2009 Action Plan; and
WHEREAS, the City applied for and was awarded Federal-Aid in the amount of
$525,000 for County Road 10 Trail Segments 1-5 fora 2009 construction start; and
WHEREAS, the City Council approved the Agency Delegated Contract Process
(DCP) Agreement with the Minnesota Department of Transportation (Mn/DOT)
designating Mn/DOT to act as the City's agent for accepting Federal funds on the City's
behalf (Resolution 7363); and
WHEREAS, plans and specifications for the County Road 10 Trail Segments 1-5
Project have been approved by the City Council, Ramsey County, and Mn/DOT's State
Aid office; and
WHEREAS, all temporary and permanent easements and wetland mitigation
approvals needed to construct the County Road 10 Trail Segments 1-5 Project have
been acquired; and
WHEREAS, the County Road 10 Trail Segments 1-5 Project was advertised to
solicit competitive bid proposals in accordance with State statutes; and
WHEREAS, eight (8) sealed bid proposals for the County Road 10 Trail
Segments 1-5 Project were received by the City on July 23, 2009 as follows:

6 Sunram Construction, Inc. $736,363.96
7 Peterson Companies, Inc. $768,930.67
8 Veit & Company, Inc. $825,354.10
and WHEREAS, Max Steininger, Inc. of Eagan, Minnesota was the lowest
responsible bidder with a total base bid amount of $653,350.31; and
WHEREAS, Mn/DOT's Office of Civil Rights has approved Max Steininger Inc.'s
"Good Faith Efforts" toward the Disadvantaged Business Enterprise (DBE) participation
for the County Road 10 Traii Segments 1-5 Project, whereby allowing the City to award
the Bid and enter into a construction contract agreement without jeopardizing Federal
funding.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the -City of
Mounds View, Ramsey County, Minnesota as follows:
1. The City accept the Bid Proposal submitted by Max Steininger, Inc. in the
total base bid amount of $653,350.31 for constructing the County Road 10
Trail Segments 1-5 Project.
2. Bonestroo is authorized to prepare construction contract agreements between
the City of Mounds View and Max Steininger, lnc. for the County Road 10
Trail Segments 1-5.
3. The City Attorney is authorized to review the prepared construction contract
agreements and any associated documentation submitted by Max Steininger,
Inc.
4. Upon satisfactory review of the prepared construction contract agreements
and documentation by the City Attorney, the Mayor and Clerk-Administrator
are hereby authorized and directed for and on behalf of the City to execute
and enter into a construction contract agreement with Max Steininger, Inc. of
Eagan, Minnesota for the construction of the County Road 10 Trail Segments
1-5 Project.

Bonestroo
Bids were opened for the Project stated above on Thursday, July Z3, 2009 at 10:00 A.M. Transmitted
herewith is a copy of the Bid Tabulation for your information and file. Copies will also be distributed to
each Bidder once the Project has been awarded.
There were a total of eight Bids. The foNowing summarizes the results of the Bids received:

The low Bidder on the Project was Max Steininger, Inc. with a Total Base Bid Amount of $653,350.31.
This compares favorably to the Engineer's Estimate of $880,000.00. These Bids have been reviewed and
found to be in order.
The Bids will be sent to the Minnesota Department of Transportation (MnDOT) for review and certification
by the Civil Rights Office. In accordance with the requirements for use of federal aid funds on this
project, the City should not award the construction contract until MnDOT has certified the Bids.
Once MnDOT has notified the City that certification is complete and the project is ready to proceed, the
City can consider award of the construction contract. If the City Council wishes to award the Project to
the low Bidder, and assuming MnDOT certifies the low Bidder, then Max Steininger, Inc. should be
awarded the Project on the Total Base Bid Amount of $653,350.31.

Max Steininger, Ino. has met the "Good Faith Efforts" requirements for Disad'vantag4d Business Enterprise
(DBE) participation on fihe above-referenced project. Therefore, the M1nnGSOta laepattment of
Transporkation's Office of Civil Rights (OCR) has cleared the CT'Es on this project today, August ~, 2009.
The City of Mounds 'View is cun•ently reviewing the remaining requirements For Contract award.
Please note that Minnesota Statute §337.10 requires prime Contractors and all subcontractors on building and
construction. contracts 'to promptly pay their subcontractors, service providers and material suppliers within
ten (10) days of their regpipt of payment from Mn/IaOT. Additiona.Ily, subject to any withholdings specified
in contract and retainage agreements, such pri,ne contractors and subcontractors are required to make
naonlhly progress payments to all subcontractors and material suppliers. Moreover, Mn/DQT requires tha!
you report on the monthly progress payments made to all your subcontractors, suppliers and service
providers, including huCkers and independent contractors. T3ncloscd is a copy of the Contractor Payment
>Form~, which your firm must complete and submit (or an approved alternative) as it makes progress
payments to all the subcontractors and suppliers it is utilizing on the project, regardless of their. tier or T~B)/
status. This Form must be submitted~to the office of Civil Rights even if there is no U13)/ participation on
the project. The Contractor Payment Form must be prepared in duplicate, and you should submit one copy !o
the Project Engineer and one. to the Office of Civil Rights within ten (10) days of any payments made to a
subcontractor. You should be aware that -f this Form is not submitted, payments may be withheld,
Furthermore, please note that prpoz• to any f.Inal payment on this contract, you must submit to our office a
notarized DBE Total payment Affidavit (copy enclosed) verit'ying the DBE participation on the project.
You must prepare this Affidavit in duplicate and send originals to our office and the Project Engineer.
