RESOLUTION AUTHORIZING ABATEMENT OF NUISANCE CODE
VIOLATIONS AT 2065 HILLVIEW ROAD, MOUNDS VIEW, MINNESOTA, 55112
WHEREAS, Timothy Strand is the owner of property located at 2065 Hillview Road,
Zoned R-3, Medium Density Residential, legally described as follows:

WHEREAS, on November 5, 2009, City staff observed exterior Nuisance Code
violations at 2065 Hillview Road; and
WHEREAS, on November 6, 2009, City staff spoke with Timothy Strand, property
owner of 2065 Hillview Road, on the telephone about the Nuisance Code violations at
2065 Hillview Road; and
WHEREAS, City staff issued an abatement order on December 4, 2009 to Timothy
Strand and requested corrective actions completed to bring the property into compliance
with Sections 607.02 Subd. 1 and 607.04 Subd. 2a of the Nuisance Code by December
14, 2009; and
WHEREAS, on December 7, 2009, City staff performed a follow up inspection of
2065 Hillview Road and found that corrective actions had not been completed; and
WHEREAS, in a letter dated December 4, 2009, City staff notified Timothy Strand
of the staff's intent to appear before the Mounds View City Council on December 14, 2009
to request authorization to abate violations cited in the Abatement Order; and
WHEREAS, Timothy Strand is responsible for correcting the Nuisance Code
violations on the exterior of the above-said property that include, but are not limited to:
1. A large hole in the ground adjacent to the building foundation.
2. Unfinished exterior surfaces on the north side of the building.
3. An obstructed exterior exit on the north side of the building.
WHEREAS, the Mounds View City Council finds that the nuisance code violations
at 2065 Hillview Road constitute a Public Nuisance under Sections 607.02 Subd. 1 and
607.04 Subd. 2a and the City may abate and assess the costs of said abatement against
the property pursuant to Minn. Stat. 429.101; and
WHEREAS,. the City has met the notification requirement for nuisance abatement as
stated in 607.09, Subd. 5b. of the Mounds View Municipal Code; and
WHEREAS, Timothy Strand, property owner of 2065 Hillview Road, will be personally
liable to the City for the costs of such abatement, including administrative costs pursuant to
Section 607.09, Subd. 7 of the Mounds View Municipal Code; and

WHEREAS, if the property owners fail to pay the cost, after being duly notified, of the
abatement of nuisance code violations at 2065 Hillview Road within 30 days after the date of
the invoice, the City may certify the unpaid costs against the property pursuant to Section
607.09, Subd. 8 of the Mounds View Municipal Code.
NOW THEREFORE, BE IT RESOLVED THAT:
The City will abate the violations of Chapter 607 of the City Code at 2065 Hillview Road no
sooner than 5 calendar days from this date (unless otherwise noted) as follows:
1. The City Council authorizes City staff to take any actions necessary to achieve
compliance with the City Code with respect to the exterior code violations of Sections
607.02 Subd. 1 and 607.04 Subd. 2a. including the filling of the large hole adjacent to
the building.
2. The City Council directs City staff to post all units in the building that are now vacant
as uninhabitable because of the existing City Code violations and building code
violations.
3. Mr. Strand shall have no more than thirty days (until January 13, 2010) to finish the
exterior surfaces on the north side of the building and to install a new exterior door on
the north side of the building to meet building code and housing standards.
4. If Mr. Strand fails to complete the necessary corrections and work to abate the code
violations by January 13, 2010, then the City will consider the property in violation of
the City rental housing standards and the City will take action to revoke the rental
housing license for the property.
5. Timothy Strand shall be personally liable to the City for the costs of abatement,
including administrative costs and reasonable storage costs.
6. The City may certify any unpaid portion of the abatement costs after 30 days of the
date on the invoice as special assessments against the property upon a duly called
hearing and pursuant to Section 607.09, Subd. 8 of the Mounds View Municipal Code.
