RESOLUTION NO. 15
A RESOLUTION ESTABLISHING RULES GOVERNING
CONDUCT AND PROCEDURE OF THE VILLAGE COUNCIL
OF MOUNDS VIE'1, MINNESOTA
The Village Council of Mounds View does resolve as follows:
RULE 1. The Village Council shall have regular sessions on the first Monday
of each month at 8:00 o'clock P.M. and, if such Monday shall fall on a holiday shall
have its regular session the next following day, or such time as the Council shall
designate prior to the holiday. Adjourned and special sessions at any other time
the Council may deem proper. The first meeting of the year shall be held on
January 2nd unless January 2nd shall fall upon Saturday or Sunday in which event it
shall be held on the next regular business day following. All meetings shall be
held at the Village Hall unless otherwise specified by the Village Council.
RULE 2. The Mayor shall preside at all meetings of the Council. In the absence
of the Mayor, the acting Mayor shall rreside. In the absence of both, the Trustees
shall elect one of thoir number a temporary Chairman. The Acting Mayor and Temporary
Chairman when occupying the place of the Mayor shall have the same privileges as
other members of the Council.
RTJLE 3. At all meetings of the Council, a majority of the Council members elected
shall constitute a quorum to do business, but a minority may adjourn from day to day
and may compel the attendance of absentees, by a fine if necessary for each offense,
unless a reasonable excuse be offered.
RULE 4. At the our appointed for the meeting, the members shall be called to
order by the Mayor, and in his absence by the Acting Mayor, and in the absence of
both, by the Clerk. The Clerk shall call the roll, note the absentees and announce
whether a quorum be present. In the absence of the Clerk, the Mayor shall appoint a
Secretary pro -tem. Upon the appearance of a quorum the Council shall proceed to the
business which shall be conducted in the following manner unless changed by the
Chairman of the Meeting.

RULE 5. The Mayor shall preserve order rind decorum and shall decide questions
of order subject to the rppeal to the Council. The Mayor may make motions, second
motions, or speak on any question. The Mayor shall be entitled to vote like other
members of the Council.
RULE 6. Every person, previous to his speaking, shall address the Chairman
and shall not proceed until he has been recognized by the Chair. Ue shall indulge
in no personalities and shall confine his remarks to the matter under debate.
RULE 7. No person shall speak more than twice on any question nor more than
five minutes each time without unanimous consent of the Council.
RULE 8. A person called to order shall immediately suspend his remarks until
the Point of order is decided by the Chair.

RULE 9. Every motion except to adjourn, postpone, reconsider, commit, lay
on the table, or for the previous questions, shall be reduced to writinE if the
Chair or any member requires it; when made and seconded, it shall be stated by the
Chairman or being written shall be read by the Clerk, and may be withdrawn before
decision or amendment, or any disposition thereof has been made, or a vote taken
thereon.
RULE 10. All resolutions and Ordinances shall be in writing.
RULE 11.
When a question is under debate no motion shall be entertained, unless
to lay on the ta111e, to act on the previous question, to postpone, to commit, or to
amend, which several motions shall precedence in the order in which they are named,
and the first two shall be decided without debate.
RULE 12. Any question shall be divided at the
same will admit thereof.
RULE 13. When a question is put by the Chair,
request of any member when

Yea or Nay when the roll is called. A member may abstain from voting, if the
majority of the Council concur with his request for abstention. The roll call shall
be recorded in the minutes of the meeting.
RULE 14. All questions shall be put in the order in which they are moved, except
in case of privileged questions.
RULE 15. The previous question shall be put in these words: "Shall the main
questions now be put It shall be admitted on demand of any two members, and until
decided shall preclude all amendments and debate of the main question.
RULE 16. All committees including standing committees shall be appointed by
the Chairman.
RULE 17. All standing committees shall consist of one or more members of the
Council, and, if desired, one or more citizens of the village. The Mayor shall name
the chairman of the commit'-e when committee is appointed. The standing committees
shall be appointed at the first business meeting of the year. Other committees maybe
appointed from time to time. Each committee shall meet at least once a month or as

directed br.y the Council except the finance committee. Each committee except the
finance committee shall prepare a 'cork schedule and budget for the coming year
and present it to the Finance Committee on or before August first of each year.
The following shall be the standing committees, with duties as prescribed:
1. Finance. The finance committee shall consist of the Council as a whole. It
shall meet from time to time and specifically on or before August 15th each rear to
receive proposed budgets and work programs from all committees and prepare a complete
village budget for the coming year.
2. License. The license committee shall meet from time to time to investigate
the license applications of the village.
3. Public Safety. (including Police, Fire, Building and Zong Regulations Etc.)
A. Police department.
1. The Police department shall be governed by Ordinance No. 50.
B. Fire Department.
The Committee shall receive a report each month from the Fire Department
which serves the Village as to day, time of day, address, nature of call
and approximate loss on each call made in the Village.
C. Building and zoning.
The Committee shall investigate violations of the Building Code and Zoning
Ordinance and the enforcement of each, as directed by the Village Council.
4. Public Works. (Including streets, sewers, water, light, etc.)
Tile committee shall make recommendations to the Council as to repair,
maintenance, re— building and or building of streets, sewers, water, light, etc
5. Public Welfare. (Including health, recreation, narks, playgrounds, and
public buildings, etc.)
The committee shall make recommendations to the Village Council concerning
the health and welfare of the Village, recreation parks, playgrounds, and
public buildings.
6. Planning Commission.

The commission shall consist of -embers as ,rovided for in Ordinance 61,
and be governed by said Ordinance.
RULE 18. It shall be the duty of each of the committees to act promptly and
faithfully in all matters referred to them,and to make their reports at the next
meeting of the Council.
RULE 19. Every Ordinance and Resolution shall be presented to the members
of the Council at least one day prior to the Council meeting. They shall be
read at the Council meeting and action taken thereon.
RULE 20. After an Ordinance or Resolutio. shall have passed, a complete and
accurate copy as amended, if need be, shall be made by the Clerk and shall be
signed by the Mayor or in his absence by the acting Mayor, and deposited with the
Clerk, who shall attest, seal, number, file and record the same permanently in the
Ordinance or Resolution book. Entry of the complete Ordinance or Resolution as
amended directly into the Ordinance or Resolution book and Original signatures
and seal thereon shall be compliance with this section. The affidavit of publication
shall be permanently inserted in the Ordinance book after each Ordinance.
RULE 21. Petitions and other papers addressed to the Council shall be read by
the Clerk upon presentation of the same to the Council.
RULE 22. All sessions of the Council shall be public.
RULE 23. The Chief of Police shall attend meetings of the Council when
requested to do so by the Mayor and preserve order in the room.
RULE 24. These rules, or any of them, may be suspended by consent of a majority
of all Councilmen, and shall not be repealed, altered* or amended, unless by
concurrence of a majority of the whole Council, and upon notice given at some
preceding meeting.
RULE 25. In all points not covered by these rules the Council shall be
governed in its procedure by Robert's Rules of Order Revised.
RULE 26. The foregoing rules are adopted to facilitate the tr'nsaction of
Council business and functions. They should not be permitted tc defeat or hinder

the plainly expressed intent and desire of the Council. Informal compliance and
substantial performance shall be sufficient under the foregoing rules in the
absence of objection seasonably taken. Objection is hereby declared not to Lave
been seasonably taken as to procedural matters provided for herein if a Council
member present at a meeting fails to object during the meeting and request
compliance with these rules, and such objection shall not be seasonably taken by an
absent member later than the next regular meeting after t?'e proceedings to which
objection is made.
RULE 27. The Council may at any time by a majority vote of those present,
adjourn from time to time to a specific date and hour whether or not a quorum is
present.
RULE 28. Specirl meetings may be called by the Mayor or any two members in
writing, filed with the Clerk at least three days prior to the time specified for
such meeting. The Clerk shall mail a notice at least two days before the meeting
to all members of the time and plane of the meeting and its purpose, if the
purpose be stated in the call filed with him. The Clerk shall prepare and file
in his office an affidavit by him showing mailing of such notices in the manner
herein prescribed.
RULE 29. Special meetings may be held without notice when all members are
present and take part in the meeting or consent in writing to hold such special
meeting without other notice. Such written consent shall be filed with the
Clerk prior to the commencement of the meeting for the transaction of any business
that may come before it.
RULE 30. Minutes of the meeting shall be kept by the Clerk or his or her
Deputy. They shall be signed by the Clerk, and shall constitute an Official record
of the Council proceedings. Upon approval of the minutes at a subsequent meeting
of the Council, the Mayor shall sign the minutes. Lack of the Mayor's signature
or the Ccancil's approval shall not invalidate such minutes as o fficial records.
RULE 31. In the event the Clerk shall fail or decline to amend or change his

minutes, upon informal request, at the time they are submitted for approval, the
Council may by motion carried by majority vote amend the minutes. Such amending
motion shall become a part of the minutes of the subsequent meeting.
