HomeMy WebLinkAboutResolution 0018RESOLTJTION 18 RESOLUTION TO SELL THE VILLAGE HALL AND PARKING LOT O'; iTED BY THE VILLAGE OF MOUNDS VIEW At a r?gular meeting of the Village Council of the Village duly held on the 2nd day of February, 1959, the following resolution wa John Sullivan and seconded by Melford Christensen, to -wit: WPEREAS, The Village of Arden Hills and the Township of Mounds View entered into an Earnest Money Contract of Sale for the sale of the following premises: That part of the NE of the Nod of Section 22, Township 30, Range 23 described as follows, to -wit: Commencing at a point 80 rods east from the Northwest corner of Sec. 22, Township 30, Range 23, thence running East 147.5 feet; thence South at right angles 147.5 feet;. thence West at right angles 147.5 feet; thence North to the place of beginning 147.5 feet, except the East 50 feet thereof and subject to the use of the North 51 feet thereof for highway purposes;, and The South 54.88 feet of the North 202.38 feet of the West 97.5 feet, except the Easterly 10 feet thereof, of said Northeast of the Northwest 1; On the 23rd day of April, 1958. The Village of Arden Hills, paid to the Township of Mounds View Twenty Five Dollars ($25.00) as earnest money and in part payment for the purchase of the said property. The Township of Mounds View agreed to sell the above described property for the sum of Ninety Five Hundred Dollars ($9500.00) On' terms as follows: Twenty -five Dollars ($25.00) cash, and the balance of the Ninety -four Hundred and seventy -five Dollars ($9,475.00) by the payment of Five Thous'nd Dollars ($5,000) cash on delivery of a Warranty Deed conveying good and marketable title to the aforesaid property, subject only to the rights of the Village of Arden Hills therein, and the balance of Four'thousand Four Hundred and seventy -five Dollars ($4,475.00) within six months from the date of delivery of said Warranty Deed, pursuant to the terms of a promissory note in said amount to be delivered to the Seller at the time of closing. Said note shall be in negotiatible form and shall bear no interest until maturity, with interest at the rate of 6% per annum after maturity, and such other terms as will be found in the earnest money contract. 36 WPTEREAS, the Township of Mounds View on April 25, 1958, pursuant to a special town meeting of Mounds View Township held on September 11, 1957, authorized the town board of supervisors to sell the above described real estate. Pursuant to the aforesaid actions, the supervisors of the Town of Mounds View and the council members of the Village of Arden Hills entered into the above described earnest money contract. ',J- i'PEAS, as on At-11 25, 1958, the Town of Mounds View, pursuant to a specia3 town meeting held on Septembe7 11, 1957 authorized the board of supervisors of the Town of Mounds View to convey by Warranty Deed all of its right and interest in real property held in the name of the Town of Mounds View to the Village of Mounds View. WTEREAS, on April 25, 1958, pursuant to the two foregoing revolutions the Mounds View Township conveyed by Warranty Deed the above described premises to the Village of Mounds View. WHEREAS, as a result of the dissolution of Mounds View Township there appeared to be some question of whether or not the Village of St. Anthony had any right in the real estate above described and conveyed to the Village of Mounds View, a quit claim deed executed on the 26th day of December, 1958 by the Village of St. Anthony conveying all of the above described premises to the Village of Mounds View was presented to the Village of Mounds View and accepted thereby. WHEREAS, on June 11, 1958, the Village of Mounds View resolved that the Village of Mounds View shall expressly ratify all act!on taken on its behalf by the town board of Mounds View; NOW THEN, BE IT RESOLVED that the Mayor and the Clerk of the Village of Mounds View be authorized to execute a Warranty Deed and any other documents required by law to completely convey the above described premises to the Village of Arden Hills, pLrou nt to the above mentioned nogotiationc and resolutions and contracts. Upon the call of the roll, the following members voted in favor of the resolution: Achterk?rch, Smith, Cl Sullivan and Gibson.
