HomeMy WebLinkAboutResolution 0082RESOLUTION NO. A RESOLUTION PROPOSING AND INITIATING THE CREATION OF A SANITARY SEWER DISTRICT. WHEREAS, the Legislature of the State of Minnesota has enacted, as Laws 1961, Extra Session, Chapter 90, a certain Special Law known as the "NORTH SUBURBAN SANITARY SEWER DISTRICT ACT and, WHEREAS, said Act has now been approved by a majority of the governing body of at least four of the following municipalities, to -wit: the Villages of Brooklyn Park, Blaine, Mounds View and Spring Lake Park, and the Cities of Coon Rapids and Fridley, and compliance with Laws 1959, Chapter 368, has been made relative thereto by such approving municipalities, and, WHEREAS, t]:e Village of Brooklyn Park, the Village of Blaine, the Village of Mounds View, the Village of Spring Lake Park, and the City of Coon Rapids and the City of Fridley, each, as one of the municipalities affected and who have made approval thereof in accordance with law, desires to obtain the benefits of such law, together with each of the other municipalities so named and affected, and to establish in accordance therewith and the authority granted therein within said municipalities a sanitary sewer district to eff- iciently, effectively and with timely and feasible means meet within the aaew affected the urgent and immediate needs for sewage collection, treatment and disposal.. NOW, THEREFORE, BE IT RESOLVED: SEC. 1: That this resolution is a separate and joint resolution of the Council of each municipality passing and adopting the same. SEC. 2: That this resolution proposes and initiates the creation of a sanitary sewer district within the limits of the Villages of Brooklyn Park, Blaine, Mounds View and Spring Lake Park, and the Cities of Coon Rapids and Fridley and is addressed to the governing body of each of said municipalities, the governing bod;: of each village being its Village Council,and of ,Ach city, its City Council. That the lands and areas of each of said municipalities are adjacent to c_:e another, and have a total population within the district as proposed of 57,547 persona according to the last United States Government census thereof. SEC. 3 That the name proposed for the district is: tti: NORTH SUBURBAN SANITARY SEWER DISTRICT. SEC. 4: That the lands and areas to be included in the proposed district and the unit of government for each are: All of the lands and areas lying and being within the territorial limits of each of the Villages of Brooklyn Park, Blaine, Mounds View and Spring Lake Park,the unit of government for each of which is the respective Village; and, also, all of the lands and areas lying and being within the territorial limits of each of the Cities of Coon Rapids and Fridley, the unit of government for each of which ie the respective City. SEC. 5: That by virtue of location, topography, soil content, governmental structure and rapid growth, to carry out with due speed and in a timely manner a policy of sanitation and water pollution prevention upon sound scientific principles in each of said municipalities, for the protection of public health, safety and general welfare, and to authorize for such purposes a system of sanitary sewage collection, treatment and disposal, there is necessary to be created within such area as an agency of the state a sanitary sewer district, which district,when created,can efficiently, effectively and with timely and feasible means meet within the area of each of said municipal- ities the urgent and immediate needs for sewage collection, treatment and disposal; and which district, when established, and its benefits can serve also to the use and needs of other municipalities contiguous or adjacent thereto. SEC. 6: That this resolution is passed and adopted by the Council of each municipality (passing and adopting the same) as the unit governing body of all lands and areas lying within the territorial limits of such municip- ality the same as if ouch lands and areas were fully set forth and described herein. SEC. 7: That a public hearing relative to such proposal and the creation cf such sanitary sewer district shall be held as provided by said NORTH CBU°.BAPI SANITARY SEWER DISTRICT ACT. That upon the t„ and adoption of his resolution and at least ten(10) days but not more than thirty (30) days before the d`e of said hearing, a copy of this resolution and the notice of hearing on the proposal to establish such district (a copy of which is attached hereto for reference purposes as Exhibit "A ",and incorporated herein the same as if fully set out) shall be seared upon the mayor or clerk of each of the other municipalities within the proposed district. In addition, the resolution and notice shall be published as required by law at leant once in the legal newspaper for each of the municipalities within the proposed district, pro- vided that such service and publication may be accomplished by the joint act of two or more municipalities who hav,s passed and adopted this resolution. The hearing shall thereafter be held in accordance with such notice, and all proceedings relative thereto may be carried on by the municipalities acting jointly, and in accordance with Laws 1961, Extra Session, Chapter 90. CITY SEAL Clerk Mayor NOTICE OF PUBLIC HEARING ON RESOLUTION PROPOSING TO CREATE A SANITARY SEWER DISTRICT WITHIN THE VILLAGES OP BROGYLYN PARK, BLAINE,MOUNDS VIEW AND SPRING LAKE PARK, AND THE CITIES OF COON RAPIDS AND FRIDLEY. WHEREAS, the Council of each municipality herein named, to -wit: the Village of Brooklyn Park,County of Hennepin, the Village of Blaine, Counties of Anoka and Ramsey, the Village of Mounds View, County of Ramsey, the Village of Spring Lake Park,Counties of Anoka and Ramsey, the City of Coon Rapids,County of Anoka and the City of Fridley,County of Anoka, have deemed it necessary and expedient by resolution duly adopted that there be created and established with- in the territorial limits of the Villages of Brooklyn Park,Blaina, Mounds View and Spring Lake Park, and the Cities of Coon Rapids and Fridley, a sanitary sewer district as an agency of the state to serve the lands and areas within each of said municipalities, and which sanitary sewer district is proposed to be created and established under the provisions of Laws 1961,T tre Seeeion 90, and to be named as "THE NORTH SUBURBAN SANITARY SEWER DISTRICT", NOW, THEREFORE, NOTICE IS HEREBY GIVEN That on the 24th day of August, 1961, at 8:00 o'clock, P.M. at the Spring Lake Park High School in the Village of Spring Lake Park a public hearing will be held on the resolution passed and adopted severally and jointly by the Councils of each of said named municipal- ities,which resolution appearing herewith proposes and initiates the creation of the said sanitary sewer district. The territorial limits of the sanitary sewer district as proposed are the same as the combined territorial limits of the Villages of Brooklyn Park,Blaine,Mounds View and Spring Lake Park,and the Cites of Coon Rapids and Pridley,and include all lands and areas within the sane. '_'`h district when created is proposed to provide the services of sewage colleeticn. treatment and disposal to all lands and areas within said municipalities,except as otherwise then or thereafter provided. All persons interested and so desiring,whether in favor of or against the proposal as made by such resolution,may and shall be heard at such hearing. The hearing will be conducted by one member of the governing body of one of such municipalities,as are herein named, which such member shall act as chairman at Jean such hearing and who shall appoint an acting secretary. The hearing will be attended by a representative appointed from and by the governing body of each of said municipalities,which representative,together with one appointed from and by the governing body of each of the other municipalities,shall constitute and at as members of an interim board of trustees. A majority of such repres- entatives as herein so named shall constitute a quorum, but less than a quorum may adjourn the hearing from time to time. The hearing may be adjourned from time to time without further notice. Following the hearing, the interim board of trustees may amend the bound- aries of the proposed district, and shall vote upon the establishment of the district as proposed or as amended. Upon a favorable vote by a majority of those voting, the sanitary sewer district shall be deemed created,eubject to and in accordance with the provisions of the North Suburban Sanitary Sewer District Act, enacted by the Legislature of the State of Minnesota in Mara Chapter pter 90 Session aa 1Laws 1961, AZLTB Se:seion. 90.
