VILLAGE OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
A RESOLUTION RELATIVE TO OPEN CUT ON COUNTY ROAD H
At ai meeting of the Village Council of the Village of Mounds View,
held on the day of 1967 at o'clock P.H. at the Village
Hall, Member moved the following resolution:
WHEREAS, the Village of Mounds View has requested permission from the
County of Ramsey to open cut County Road H for the installation of sanitary sewer
and water extensions, and
WHEREAS, at its regular session held on April 10, 1967 the County Board
reconsidered its action to deny a request of the Village of Mounds View for
permission to open cut County Road H for sanitary sewer and water extensions, and
WHEREAS, the Board of Ramsey County Commissioners will now grant the
permission to open cut subject to the following conditions:
NOW, THEREFORE BE IT RESOLVED, that in return for permission to allow
the Village of Mounds View to open cut County Road H for sanitary sewer and water
extensions the Village of Mounds View agrees as follows:
1. That Ramsey County shall be named as a party to the performance bond
of the contractor and that said county will be a beneficiary to x.11 terms of
said bond and that in particular the contractor will agree to replace County Road
H to its condition before the open cut;
2. That the Village of Mounds View agrees that County Road H will be
replaced to its condition before the open cut, and will guarantee that said County
Road H at the site of said open cut shall be maintained and restored for a two year
pertpd from the date of the restoration;
3. That it shall be left to the determination of the Ramsey County Engineer
what repair work will be necessary as to the original replacement of the road.
In the event the repair work must be undertaken by the County Engineer's Department,
the Village of Mounds will guarantee the recovery of expenses from either the
Village, or the contractor, or the contractor's bond.
Member seconded the resolution, those voting in favor:
those voting against;
whereupon the Mayor declared the resolution duly adopted this day of

I, the undersigned, the duly qualified and acting Clerk of the Village of
Mounds View, Minnesota, DO HEREBY CERTIFY That this is a true and correct copy
of a resolution relative to open cut on County Road H passed by the Village Council
o n the J/ day 4 I 1967.
