VILLAGE OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE THE
LAND ACQUISITION POLICY STATEMENT.
At a regular meeting of the Council of the Village of Mounds View held

Village Hall located at 2401 Highway 10, New Brighton, Minnesota 55112, with the

WHEREAS, the Village of Mounds View has applied to the Department of Housing
and Urban Development for a water facility grant, and
WHEREAS, said department requires that the Village adopt a land acquisition
policy, to be executed by the Mayor,
NOW, THEREFORE, BE IT RESOLVED that the Mayor of the Village of Mounds View,
Ingram C. Rustad, is hereby authorized and empowered to sign the attached Land
Acquisition Policy Statement on behalf of the Village of Mounds View.

I, the undersigned, being the duly qualified Clerk of the Village of
Mounds View, Minnesota, DO HEREBY CERTIFY that I have carefully compared the attached
and foregoing extract of minutes of a meeting of the Village Council of said Village
held on the date therein indicated with the original minutes thereof on file in my
office and that the same is a full, true and correct transcript thereof insofar as
said minutes relate to a resolution authorizing the Mayor to execute the land
acquisition policy statement.

LAND ACQUISITION POLICY STATEMENT
The Village of Mounds View hereby adopts the following land acquisition
policy relative to the acquisition of real property for the water facilities
program:
1. The Village of Mounds View will make every reasonable effort
to acquire the real property by negotiated purchase before
instituting eminent domain proceedings.
2. The Village of Mounds View will not require any owner to
surrender possession of real property until the Village pays,.
or causes to be paid, to the owner the agreed purchase price
arrived at by negotiation, or in any case where only the amount
of the payment to the owner is in dispute, not less than 75°% of
the appraised fair value as approved by the applicant and
concurred in by HUD.
3. The Village of Mounds View will not require any person lawfully
occupying property to surrender possession without at least
90 days written notice from the Village of the date on which
possession will be required.
