HomeMy WebLinkAboutResolution 0369At its regular meeting held en the 25th day of March 1968 at the Village Hall located at 2401 Highway 10 with the following members present: and the following members absent: RESOLUTION NO. 369 EXTRACT OF MINUTES OF MEETING OF THE VILLAGE COUNCIL OF THE VILLAGE OF MOUNDS VIEW, MINNESOTA the Village Council of the Village of Mounds View adopted the following resolution: 1 age Clerk A RESOLUTION APPROVING SECOND RIDER TO BOARD OF WATER COMMISSIONERS AND VILLAGE OF MOUNDS VIEW AGREEMENT. Member Rustad moved the following: WHEREAS, the Village of Mounds View having entered into an agreement with the Board of Water Commissioners dated 27 October 1965, for the purpose of locating certain public works within lands in Sections 6 and 7, Township 30, Range 23, in Ramsey County; and, WHEREAS, the Village has requested that said agreement with the Board be amended to add installation of a power pole for a street light on the Board's easement; and, WHEREAS, the General Manager recommends that such installation be approved. NOW, THEREFORE BE IT RESOLVED, that the Village of Mounds View hereby approves said second rider to the agreement and hereby authorizes and directs the Mayor and Clerk to execute said rider on behalf of the Village. The motion for the adoption of the foregoing resolution was duly secondea by Member Lang and upon a vote being taken the following members voted in favor thereof: and the following members voted against the same: whereupon said resolution was declared passed and adopted. VILLAGE OF MOUNDS VIEW) I, the undersigned, being the duly qualified Clerk of the Village of Mounds View, Minnesota, DO HEREBY CERTIFY that I have carefully compared the attached and foregoing extract of minutes of a meeting of the Village Council of said Village held on the date therein indicated with the original minutes thereof on file in my office and that the same is a full, true and correct transcript thereof insofar as said minutes relate to a resolution approving second rider to Board of Water Commissioners and Village of Mounds View agreement. (SEAL) /24/44 Vi lage Clerk SECOND R IDER TO A G&t EEWEN f THIS AGREEMENT rlade this 25th day of January 1968, by and between the'BCARD OF HATER COMMISICNER of the City of Saint Faul, hereinafter called the B:.;;rd, and the VILLAGE OF WOUNDS VIEW, COUNTY OF RAILSEY, MIIIIESCTA, hereinafter called the Village, being a Second Rider to that certain Agreement made by end between said Board and said Village the 27th day of October, 1965, and by this reference incorporated herein and made part and parcel hereof with the swine intent, purpose and effect as if said Agreement were set forth herein, verbatim. WITNESSEIN: WHEREAS, The Board now possesses title to an easement in certain real estate lying generally north of and adjacent to County Road I, in Section 6, Township 30, Range 23, in Ramsey County, said real estate being hereinafter called Prs and WHEREAS, The Village desires permission to enter upon certain portions of said Premises and to thereon install, maintain and erect a street light; and WHEREAS, The Board is willing to grant said permission to the Village consistent with the requirement and safety of the works of the Board, NOW, THEREFORE, BE IT AGREED, In consideration of the mutual promises and agreements of the parties hereto: That subject to all the terms and conditions contained in said Agreement between the parties .hereto made and entered into the 27th day of October 1965, the bard hereby grants to the Vil1o,1e the right to use and maintain a street light and to install a power pole in the Board's easement to be located at the northwest corner of Greenwood Drive and County Road "I said location to be approved by the Board's engineer.
