VILLAGE OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
A RESOLUTION COVERING PUBLIC WORKS MAINTENANCE
EMPLOYEES IN THE MAINTENANCE DEPARTMENT OF THE
VILLAGE OF MOUNDS VIEW FOR THE YEAR 1969
The following resolution was moved by Member Rusted as
ARTICLE I
Seniority
Section 1. A policy of Seniority shall be formulated that will
give permanent employees with longer periods of service an opportunity for
promotion and also give all employees a feeling of security.
Section 2. New employees shall be on a six -month probationary period.
Section 3. There shall be a seniority list established which shall
include the Maintenance Department based on their original date of hire.
Section 4. In the event of lay off due to lack of work, permanent
employees with the least seniority shall be the first to be laid off, and in
the event of rehire the last employee laid off shall be the first to be rehired.
Section 5. In the event of a job opening, the job shall be
announced by bulletin and the oldest permanent qualifying employee shall be given
first opportunity to step up for promotion.
Section 6. Permanent employees shall not be reduced in pay scale
when assigned work of a lower classification. Employees performing work of a
higher pay classification shall receive the wage scale prevailing for the higher
classification according to Article VIII, Section 3.
Section 7. No permanent employee shall be laid off out of turn on
the seniority list.
Section R. In the event of discharge, the employee or his
representative shall be entitled to a hearing before the Village Council. This
hearing shall take place within fifteen (15) calendar days of discharge date
upon the request of the employee or his representative. If it is then determined
that the employee has been unjustly discharged, he shall be reinstated at once
and all wages and other benefits lost during his time off shall be credited to him.,
Section 1. All permanent employees shall be credited with one (1)
day of sick leave for each month worked. Sick Leave shall be accumulative to a
maximum of one hundred (100) days. Sick Leave will be granted for actual sickness,
temporary physical disability, serious illness or death in the immediate family
or quarantine. The Village Council, at their discretion, may require a Dictor's
Certificate showing the nature of any injury or illness.
ARTICLE III
Severance Pay
Section 1. All permanent employees who have completed five (5) years

of service within the Village shall be entitled to se% of the unused sick leave
as severance pay upon retirement or if they become disabled so they must terminate
their employment.

Sick Leave
Section 1. All employees shall be granted leave of absence with
New Year's Day
Good Friday
Labor Day
Thanksgiving Day
Lincoln's Birthday
Memorial Day
Christmas Day
ARTICLE IV
Holidays
on all legal holidays. These are:
Section 2. New Year's Day, Memorial Day, Independence Day, and
Christmas Day will be considered "major" holidays. When any such major holiday
falls upon a Sunday, the following Monday shall be considered a holiday for all
employees. When a major holiday falls upon a Saturday, either Friday or Monday
will be considered a holiday for all employees. The minor holidays are allowed
only if they fall on a regular working day.
Section 3. At the discretion of the Superintendent, one -half the
crew shall have Lincoln's Birthday off, the remainder to take Washington's Birthday
off.
ARTICLE V
Vacations
Permanent employees shall be granted the following vacation schedule:

Veteran's Day
Columbus Day
After 1 year's service 2 weeks
After 5 year's service 3 weeks
Afti-r 20 year's service 4 weeks
Employees with two weeks' vacation due must take at least one week
of said vacation days consecutively.
Employees with three weeks' vacation due must take at least two weeks
of said vacation days consecutively.
Employees with less than two years of service shall have their
vacation prorated at 5/6's day per month.
Employees with three or four weeks' vacation due must take at least
two weeks of said vacation days consecutively.
Vacations must be schedule by March 1st each year.
An employee may hold over ten (10) days maximum into the next year.
ARTICLE VI
Hours
Section 1. The regular work day for employees shall be eight (8) hours.
2. The regular work week for employees shall be forty (40)
hours, and shall be five (5) consecutive days excluding Sunday.
Section 3. The average work month for employees for purposes of
computing vacations, sick leave, and fractions of a month's work shall be one
hundred seventy -three (173) hours.
ARTICLE VII
Overtime
Section 1. Overtime is defined as all hours worked in excess of eight
(8) hours per day or forty (40) hours per week, and for all hours worked on the
sixth (6th) day, Sunday, and legal holidays or days ovserved as holidays.
Section 2. Overtime for all employees shall be paid as it is earned
at the rate of time and one -half cash payment. On the five scheduled work days,
the compensatory time shall be time and one -half. On the 6th day and Sunday,
holidays, and days observed as holidays, it shall be time and one -half cash
payment.
Section 3. An employee called back to work after he has completed
his regular work day or called out on his day off shall receive a minimum of two
(2) hours' compensation at the overtime rate.

Section 2. These wages shall be effective January 1, 1969 through
December 31, 1969.
Section 3. Employees working at a higher classification for a period
of five (5) consecutive days shall receive the rate of pay for the higher
classification.
Section 4. An employee who works 50% or more in a one -year period at
a higher job classification shall be eligible for reclassification.
Section 5. Public Works Maintenance Men shall be required to operate
Vil, equipment and perform duties as directed by the Superintendent.
ARTICLE IX
Duration
This resolution shall be in effect from the date of its passage
through the 31st of December, 1969.

whereupon the motion was declared to be adopted the 16th day of
December 1968.
